Republican U. (CHICAGO)(August 18, 2009) For the first time in a long time Illinois conservatives will be part of a focused team at the Illinois State Fair’s “Republican Day.” U. S. Senate candidate Andy Martin is creating a Green Beret-style “fighting camp” in Springfield to organize Wednesday’s and Thursday’s protests against his opponent “Infanticide Congressman” Mark Kirk.

“Rightly or wrongly, fairly or unfairly, conservatives do not feel welcome in the Illinois Republican Party,” Martin says. “Well they are now. My campaign is spearheading a ‘campaign within a campaign,’ to welcome conservatives ‘home’ and provide support for protests both Wednesday at the Pasfield House Inn and Thursday at the Illinois State Fair’s ‘Republican Day.’

“Wednesday we will have a 1:00 P.M. state court hearing to define our protest rights at the State Fair. Later Wednesday we will be protesting as fat cat Republicans munch on shrimp and champagne at the Pasfield House Inn. Thursday, we will be all over Springfield taking this message to the people of Illinois: conservatives are back, and conservatives have a real candidate for United States Senator.

“Conservative have been demoralized and disorganized by the disruptive tactics of liberal party leaders in Chicago. The state party headquarters for Republicans is a hotbed of liberalism and louche lifestyles. These people have labored mightily and brought forth a mouse: Mark Kirk for U. S. Senator. Kirk is a joke.

“But Kirk is being supported by liberal media and by bogus ‘conservatives’ such as Don and Roma. If you want to know how out of touch liberal media are with the people, just look at the media’s monolithic support for Kirk.

“Kirk is not a ‘liberal Republican.’ His views place him on the extreme left of the Democratic Party. No wonder the media love him.

“Kirk’s support for infanticide, known to liberals as ‘partial-birth abortion,’ is radical, not liberal. Americans are not of one mind about the challenges posed by abortion. But we almost approach unanimity in being repelled by infanticide. Except for Mark Kirk.

“The liberal party establishment is trying to force Kirk down the throats of mainstream Main Street Republicans. I am there to lead the opposition.

“Unlike the many vaporous conservative ‘candidacies’ that have flitted across the sky, I am the only experienced, organized opponent facing Mark Kirk.

“Thursday marks Kirk’s debut at an ‘unorganized’ and uncontrolled event, unlike the invitation-only love-fests he has been holding to avoid public contact and Republican rejection. We aim to let Kirk know his candidacy for U. S. Senator as a Republican is a joke.

“Illinois Democrats also need a credible senatorial candidate. Kirk would be a perfect fit. ‘Go Mark Go. To the Democrats,’” Martin will state as he pursues Kirk across Springfield on Wednesday and Thursday.”

Andy Martin’s Verified Motion for a Temporary Restraining Order

Republican U. S. Senate candidate Andy Martin has filed a lawsuit in the Circuit Court of Sangamon County, Springfield, Illinois. This is the full text of his emergency motion seeking to bar illegal practices by “Combine Republicans” and the State Fair.

VERIFIED MOTION FOR TEMPORARY RESTRAINING
ORDER AND ORDER TO SHOW CAUSE

The Plaintiff asks this Court to issue two (2) separate orders on an emergency basis: (1) a Temporary Restraining Order (“TRO”) barring the Illinois Department of Agriculture (“Agriculture”) or Illinois State fair (“ISF”) or persons acting under Agriculture/ISF from interfering with Plaintiff’s protests at the Illinois State Fair on August 20, 2009; (2) an Order to Show Cause (“OSC”) directing the Republican Party defendants to show cause why Plaintiff should not be granted access to the Republican National Committee’s (“RNC’s”) Voter Vault (“VV”). The TRO and OSC are independent of each other.
1. Factual allegations
The facts governing each of these issues are set forth in the attached Complaint.
A. With regard to the TRO, plaintiff has been in negotiation with Agriculture, but has been unable to reach a written agreement as to the terms and conditions for Plaintiff’s use of the Illinois State Fair Premises (“ISF”) for “Republican Day.”
B. As to the RNC issues, the VV is made available to Republican candidates. But because of the corruption and hostility of the Illinois Republican Party (“IRP”) to “reform Republicans,” the VV is not being made available to Plaintiff to harass him as a candidate for statewide office.
2. Legal standards
A. The legal standards governing a TRO are straightforward, see Wilson v. Hinsdale Elementary, 349 Ill.App.3rd 243, 810 N.E.2d 637, 642 (Court of Appeals, 2d Dist. 2004).
3. Argument
A. The TRO
a. Plaintiff is not seeking unrestricted access to the State Fair. He is seeking access on a specific day which the ISF has designated as “Republican Day.” Thus, the ISF itself has allowed and invited Republicans to attend. The essence of political parties going back to Jeffersonian days is that parties have factions. Plaintiff represents mainstream Republicans; the defendants represent “Combine” Republicans. The term “Combine” was coined to describe Republicans-cum-Democrats who exercise dictatorial political powers over Illinois government on a continuing basis, all of which power is lubricated with corruption, self-interest and political duplicity.
b. The TRO/ISF claims arise under 42 U.S.C. § 1983. If the ISF is going to specifically host a “Republican Day,” then it must make reasonable accommodations for conflicting factions in the Republican Party.
c. The ISF claims it has established a "protest area" at a great distance from the Director's Lawn, while some Republicans will be allowed to meet at the Director’s Lawn. Protests which are removed from the area of actual conflict are not protests at all; they are meaningless and hollow gestures which reflect unconstitutional abridgement of political speech.
d. Plaintiff was able to resolve a much more complex protest issue with the Chicago Police Department, without the need to file a lawsuit. Chicago’s streets and sidewalks are crowded and congested. But the CPD was able to accommodate Plaintiff. The ISF is sticking rigidly to vague rules which seek to render Plaintiff’s protest nugatory.
e. Likewise, one faction of the Republican Day crowd has already been granted use of sound amplification. Plaintiff only seeks to use his own sound amplification at a reasonable level. The “rules” of the ISF are vague and offer unfettered discretion on the ISF to control "sound devices." A grant of unfettered discretion to a state official is unconstitutional. Once again, the ISF is taking a wooden approach to resolving what should have been resolved without a lawsuit.
B. The OSC
a. The Republican Party (RNC) has crated a database called the VV. The VV is made available to Republican candidates, and has been made available repeatedly to Plaintiff’s political opponents, including defendant Mark Kirk.
b. Making the VV available to only one of a number of candidates may violate federal election law, which bars excessive contributions to a single candidate in a primary election, as well as Illinois election law, which may bar use of state funds for a single federal candidate. In addition, the VV has been made available on an unrestricted basis to Republicans. In the most recent statewide primary Plaintiff received almost 35% of the statewide vote, and carried numerous downstate counties.
c. The RNC defendants are seeking to sabotage Plaintiff’s campaign for federal office, and sabotage the rights of downstate voters in particular to be reached through information contained in the VV. Such action by the defendants is inequitable and unlawful.
C. The legal criteria for relief
a. “Certain and Clearly Ascertainable Right”
The defendants themselves have designated a special day as Republican Day. They have invited Republicans to protest, and then sought to render protest meaningless. Do they suggest there is only “one” Republican voice? Or a monolithic party? That is obviously an unreasonable belief under any circumstances. Having invited “Republicans,” the ISF has to accommodate all Republicans. Likewise, the VV has been made to Plaintiff’s opponents; he has the same right of access as his opponents.
b. “Inadequate remedy at law”
There is no adequate remedy for denial of First Amendment Rights. Likewise, the VV is a massive compendium that has been created to assist candidates such as Plaintiff. Because of the constraints of time and cost, it would be impossible for any candidate to duplicate the VV.
c. Irreparable injury
The issue of irreparable injury given that Plaintiff is a candidate for federal office and seeks to demonstrate on only one day, billed as “Republican Day” by the ISF itself, in the area of the Republican congregation at the Director’s Lawn, cannot seriously be questioned, Cooper v. Rockford Newspapers, 50 Ill.App. 3rd 250, 365 N.E.2d 746, 750 (Court of Appeals, 2d Dist 1995) citing Elrod v. Burns, 427 U.S. 347, 373-374, 96 S. Ct. 2673 (1976).
d. “Likelihood of success”
With all due respect, Plaintiff has an excellent likelihood of succeeding on his claims that (1) the ISF has vague and unconstitutional standards for political speech on specific days when the ISF itself invites political speech by scheduling a “Republican Day” and a separate ”Democratic Day,” Elrod. The actions of the RNC/IRP defendants are arbitrary, capricious and violate the rules of the RNC itself. Plaintiff is an intended beneficiary of the RNC’s rules and procedures for VV access. Plaintiff has complied fully with the VV procedural requirements.

“Infanticide” Congressman Mark Kirk faces ultimatum in Illinois primary

Illinois U. S. Senate candidate Andy Martin says Kirk’s dirty tricks will elicit a devastating response. Kirk’s efforts to rig the Republican primary and muzzle his opponents will boomerang and undermine the entire ticket in November 2010. Martin is preparing to confront Kirk at the Illinois State Fair, as the nation’s first primary on February 2, 2010 becomes increasingly contentious. Martin says state party chairman Andy McKenna is taking Illinois Republicans backwards. Republicans could not break 40% against crooked governor Rod Blagojevich in 2006; they could not break 30% in 2008. Martin attributes Republican losses to a corrupt Republican state party leadership.

Dear Andy:

I was deeply disappointed, but not surprised, at the shenanigans of your little munchkin “Chicago Young Republicans” Wednesday night. They have picked up all of your bad habits trying to rig elections and harass candidates. Maybe that could be your/their new slogan: “Chicago Young Republicans, Same Old Dirty Tricks.”

Ironically, we documented in writing that what took place would not take place. I will be filing a lawsuit shortly about the fraud involved in lying to a statewide candidate. And, as I said, we have the misrepresentations in writing. What would you expect with a chumbolone like Lee Roupas running the show (I don’t know the Greek word for chumbolone, but maybe John Kass will helpfully provide it)?

Because you are the State Chairman and you participated in the charade, I hold you fully responsible for Wednesday’s spectacle. Muzzling me as a candidate for U. S. Senator to promote my opponent, Mark Kirk, was a major blunder on your part. As a result of your dirty tricks, we are ratcheting up our attacks on Kirk.

While you apparently do not like to answer letters, I make it a practice to put matters in writing and on the record. Unlike Mark Kirk’s secret life, there are no secrets in my campaign.

So here are my three points:

First, you are killing Mark Kirk’s campaign. Your dirty tricks and your denigration of freedom of speech are going to result in a statewide uprising that is going to defeat Kirk in the primary. Republicans want a fair and open and above-board primary. The shabby behavior you manifested on Wednesday is unacceptable.

Your dirty tricks provoke and necessitate a harsh response: you are turning a campaign that should be based on debates over the issues into a battle over Kirk’s slimy behavior and your attempts to prevent an open primary. Kirk can run, but he can’t hide. His 10-year charade is over.

I don’t think a man with a secret life such as Kirk benefits from efforts to stage a secret primary on his behalf. My prediction: if you keep up what you are doing, you will defeat Mark Kirk in the primary.

If you conduct an honest and fair primary, and Mark wins fair-and-square, most Republicans will accept the outcome. I know I will. But no one will accept an outcome orchestrated by the kind of dirty tactics employed against me on Wednesday night or Tolbert Chisum’s abuse of his role as New Trier Committeeman in 2007. The choice to go dirty was yours; I feel you will regret it. I know Mark Kirk will.

Second, you have a history of killing Republican candidates. Mark Kirk would be the third. In 2006, your manipulation of the gubernatorial race nominated “Goofy Judy.” She could not even break 40% against a crook. Not a good showing. I understand Goofy Judy is trying to make a comeback. If she does, the left will use her to undermine whoever wins the current gubernatorial primary. It is time for Goofy Judy to go quietly.

In 2008, you rigged the primary and corrupted the State Central Committee with a bogus “endorsement” to harass my campaign. Your chosen man Sauerberg did not even break 30%. Republicans voted against their party.

In other words, from election cycle to election cycle, your handiwork knocked the party backwards 10% in public support. Don’t blame the Democrats. Rod Blagojevich was still in office. But Republican voters dropped by 10%. Not a good showing on your part.

Somehow, you never appear embarrassed at your failures. With a record such as yours, most people would resign and go into hiding. Still you labor on, using the same dirty tricks against me that have failed before.

Third, here is my suggestion and proposal. I will offer to debate your candidate, Marky Mark Kirk, on the issues, if you agree in writing to conduct a fair an open and impartial primary. That means no muzzling or abuse of my campaign, no bogus endorsements by Tolbert Chisum, and no other dirty tricks.

If he wins, Kirk has my support.

Your acceptance would have to be in writing, ratified by the SCC and enforceable in and at every Republican Party meeting, function, etc. It would be a blanket agreement. No exceptions. No Roupas loopholes.

You should start by announcing in writing that you are ensuring that all candidates will be treated equally and given equal time at the Illinois State Fair. Your failure to respond to this letter will be deemed an admission that you are contemplating more dirty tricks on Republican Day August 20th.

You should talk with your National Committeeman. Although I am not a fan of his, he was proffered as an experienced lawyer. Any competent lawyer would tell you that your dirty tricks are going to backfire and injure, not aid, your candidate.

If you continue to conduct a crooked campaign, the primary will only be phase one in a campaign to defeat Kirk in the general election. A crooked primary cannot yield an honest candidate. Just remember “29% Sauerberg.” Twenty-nine percent.

I would suggest that you respond by Monday, August 10th at 5:00 P.M. in writing and by fax to this offer. If I have not heard from you by then, I will take any and all appropriate steps to defeat Mark Kirk and to run you and your gaggle of perverted politicians out of the Republican Party. You have one foot out the door already; if you keep playing dirty with Republican candidates, the remaining foot will not remain inside much longer.

The choice is yours.

Re: Republican Day at the State Fair/August 20th

Dear Tom:

I left a message with your office to call me; please feel free to do so at any time. I am not one of those Beltway big shots. I answer my own phone a lot of the time.

The Illinois Republican Party is split. No secret there. There is the faction led by the billionaire bonus baby Andy McKenna, who in typical corporate fashion had his father buy control of the Republican Party apparatus for the benefit of his patrons in the Daley Machine.

McKennacrats seek to drive the party in a left-wing direction, and are supporting my opponent, extremist liberal Mark Kirk, for U.S. senator.

And then there is my campaign for U. S. Senator. I am the only Republican who has previously run a statewide campaign. In 2008 I received 35% of the vote. I have been described as “neither far right nor far left.” That’s a fair assessment. I judge every issue on its own merits. The Constitution is my secular Bible.

Not surprisingly, Kirk’s supporters are trying to rig Republican Day at the State Fair to unlawfully and improperly and unconstitutionally exclude me. They are trying to prevent Republicans from having an honest and open primary campaign. They want to pretend Kirk has no opposition in the primary. Liberal Chicago news media are assisting them in this charade.

Kirk & Co. pulled some of their preliminary dirty tricks in Chicago this week, where they only permitted Kirk to speak at a Republican Party function. We will be filing a lawsuit and, amazingly, we have their shenanigans in writing. There is no need to speculate on whether they lied; we have it in writing.

McKenna and Kirk are trying to muzzle conservatives so Kirk’s support of infanticide and his odious personal life will not become statewide issues.

That brings me to the State Fair.

Every Republican should be welcome to come to and participate in Republican Day, not just the “Infanticide Wing of the Republican Party (Mark Kirk supports partial-birth abortions).”

McKenna & Co. have reserved the Director’s Lawn. We would like to bring megaphones and banners to the same general area, but we will stay outside the enclosure and remain peaceful at all times. (Earlier this week we had a peaceful demonstration at a Kirk event, and the Chicago Police Department provided protection for us; all went well.)

We would like to do the Republican Day demonstration in coordination with both police protection and cooperation with State fair staff. Our goal is to be confrontational, but peaceful and extremely polite. After all, we are the real Republicans.

I would appreciate if you and I could speak, and afterwards if your staff could coordinate with me. I will certainly be the conservative Republican voice at the State Fair on Republican Day.

I am sure we can work everything out. For my part, I would like to confront the McKennacrats at the Director’s Lawn, but only in a peaceful and respectful manner (but of course, with banners and megaphones). We will probably want to bring a table and chairs.

In my opinion, where there is intra-party primary competition, the state fair is constitutionally required to make reasonable accommodations for all factions, and to allow these competitors to “confront” each other in a reasonable manner.

I represent the real Republican Party. Mark Kirk is Barack Obama’s favorite “Republican." There is no way Kirk represents real Republicans. No way, shape or form. On August 20th we will carry that message to the Director’s Lawn entry area (but not inside) at the State Fair.

I would appreciate your prompt assistance and cooperation as we exercise our political and constitutional rights.

Please reply promptly so we may confirm and firm up arrangement. We may be filing a lawsuit in Sangamon County Circuit Court against Kirk, McKenna & Co., and we would prefer to keep the State Fair out of the litigation.
