(CHICAGO)(August 22, 2009) There is more than a possibility that Andy Martin’s lawsuit filed last Friday against Andy McKenna, and the corrupt “Combine” of which he is a member, caused the Combine’s leadership to pull the plug on the hapless McKenna.
By Thursday, the same lawsuit had led a Sangamon County circuit judge to chastise the Republican Party’s lawyers for muzzling Martin and violating an agreement with the Court to allow Martin to participate in Republican Day at the Illinois State Fair.
McKenna thought Martin’s lawsuits were jokes; now McKenna has personal experience that lawsuits have consequences. He’s outta there. The poor little rich boy paid the ultimate price.
Andy Martin said Friday, “Andy McKenna left Illinois politics the same way he entered: marinated in dirty politics and overwhelmed by his own incompetence. McKenna first came to my attention when he used a Crime Syndicate hoodlum, Andy Raucci, to harass me in 2003. Six years later, McKenna was still harassing me and my campaign. Only now he’s disgraced and discredited and I am still a major candidate for the U. S. Senate. Clearly, I had more mojo than McKenna.
“Kirkie-boy is McKenna’s embarrassing legacy to the Republican Party. McKenna’s abuse of his leadership role to support Kirk’s campaign blasts a big hole in the Kirk operation. My guess is that with McKenna gone, I will be able to pull an upset and defeat Kirk in the primary.
“Kirk has no doubt been promised a job in the Obama administration, by his best bud Rahm Emanuel. It was amusing to see Kirkie dumping on his Obama friends Thursday. Kirk can’t even lie convincingly. Or maybe he lies too well.
“Ultimately, the ‘doctrine of unintended consequences’ will make my campaign the major beneficiary of McKenna’s removal as State chairman.
“At the end of the week: I am still a leading candidate for U. S. Senator, Mark Kirk campaign’s is seriously weakened through the removal of his unscrupulous supporter, and the Combine feels endangered. Not bad for a week’s work,” Martin said. {His lawsuit was filed last Friday, August 14th.]

Here is my response, posted on the blog. It may help you understand why the judge ruled in my favor, and why he was disgusted with the slimy lawyers representing the Fair and Republican Party:
A couple of clarifications may be in order to your active web post. First, the reader who suggested there was a deal reached Wednesday for my presence at Thursday’s Republican Day is correct. We reached an amicable settlement on Wednesday. Part of the deal was that I would forego a bullhorn, and only use my own voice. I honored the deal. Republicans reneged. That was why the judge was so angry. (The claim I used a bullhorn is thus completely false.)
Second, for the writer who says he “was there” when I said Kirk would boil partial birth aborted babies in oil, I was obviously saying that in a tongue-in-cheek manner and poking fun at Kirk’s support for partial birth abortion. If you are for killing living babies, as Kirk is, how does it change the context if you ridicule such a position by comparing it to boiling babies in oil? Killing living babies is killing living babies. I seem to remember the satirist Jonathan Swift used similar exaggeration. Lighten up. (Unless you are afraid the partial birth abortion supporters don’t care what happens with the dead babies' “carcasses.”)
I am sorry some of your readers do not like me. Most people who know me view me as a reasonable person. But I respect your readers’ right to free speech. Now if only the Republican Party would respect my right to free speech, we would not be embarrassed on February 2nd by Mark Kirk as our senate candidate.
And yes, my web sites and blogs are filled with anti-Kirk remarks. Kirk’s ridiculous campaign as a “Republican” for statewide office is the only issue in the primary. In the not-so-humble opinion of Republican Party leaders, they believe I am the strongest candidate to defeat Kirk. Why do you think they are censoring me and trying to undermine my campaign? Because I am a chumbolone like the other “senate candidates” they allowed to speak in Springfield? No. They are seeking to muzzle me because I am the only option to beat Kirk.
If I do defeat Kirk, I am probably the only Republican who can also go on to defeat Giannoulias. Who do you want in Washington? Andy or Alexi?

Finally, I also have the highest respect and admiration for Judge Kelley. He is an extraordinary talented and decent jurist. The judge dealt exceptionally fairly with all parties at the hearing on Wednesday. We all left smiling that a deal had been reached. The judge became angry on Thursday when Republican lawyers reneged, and a slimy lawyer for the Department of Agriculture, Margaret Van Dijk, as well as Republican John Fogarty, insulted the judge’s efforts by telling Illinois State Police there was “no court order” for my presence at the Fair and filing a false criminal complaint against me.
When parties settle a case by agreement, the Court usually does not enter a formal order. Judges trust lawyers to be honest with the court and each other. Fogarty and Van Dijk lied to the Court and to the State Police. They will be held accountable.
As soon as I arrived at the State Fair, Fogarty violated the earlier agreement with the judge. The lawyers lied; the judge was angry. Case closed.
Republicans are also giving Kirk access to the party’s Voter Vault, and denying me access. The court battle goes on.
And no, no one is going to be sued for voicing his opinion on TheCapitolFax blog. I sued because they were denying me free speech. The judge said Wednesday I had filed a valid lawsuit. Why can’t some of your readers respect the fact that the judge ruled in my favor and respected my legal acumen, and respect me for fighting to open up the Republican Party and fight for the free speech rights of everyone?

(CHICAGO)(August 21, 2009) A visibly angry Sangamon Circuit judge Thursday chastised Republication Party leaders for seeking to silence U. S. Senate candidate Andy Martin. The judge compared the Republican tactics to “trailer trash.” “I feel as tough I am overseeing a trailer park,” Chief Sangamon Circuit Judge Patrick Kelley said in an emergency hearing. The court protracted Andy Martin's free speech rights for the second day in a row.
“We are extremely encouraged by the judge’s ruling,” Martin said. “We are now going to convert a lawsuit that was started as an injunction case to add claims for money damages against Mark Kirk’s campaign cash as well as others. Kirk may be raising millions in dirty dollars, but we are going to seek a freeze on those funds while the lawsuit is pending.”
Republican Party lawyers tried to terrorize Martin while he campaigned against Kirk Thursday at the Illinois State Fair's "Republican Day." Martin stood his ground and in a second court hearing in as many days, Martin prevailed fully on his arguments that Republican leaders were unconstitutionally trying to muzzle him.
“We settled the case on Wednesday,” Martin said. "And they reneged on Thursday. The judge was visibly angry. A crooked series of Kirk lawyers involving Brian Sheehan, John Fogarty and Department of Agriculture attorney Margaret Van Dijk tried to renege on their deal by using the Illinois State Police as fascist bully boys to harass me. The behavior of the State Police was deplorable.
“Van Dijk told me Brian Sheehan has ‘filed a criminal complaint against you.’ Sheehan was trying to undo the Wednesday settlement negotiated by his own attorney! What a joke.
“I was surrounded by approximately ten (10) state police, including a Captain, a Lieutenant and 8-10 other state troopers. Why are these men and women not out catching crooks? Why are they being used as fascist storm troopers to silence Kirk’s election opponents? We will be filing Freedom of Information demands and joining the State Police in the reconstituted civil rights conspiracy.
“The Director’s Lawn became an armed camp as police surrounded and shadowed me. I said that we should go back to court, we did, and the judge agreed with me completely. He rejected Fogarty’s claim that there were ‘too many’ Republican candidates to permit me to campaign. He rejected Fogarty’s claim that there was a ‘free speech’ area a mile away from the Republican Party, saying ‘don’t go there, we resolved that.’
“Acting as a proxy for Mark Kirk, the Republican Party lost on all of its arguments. The judge asked 'Why don’t you just let Mr. Martin speak?' Republican lawyers said they would not.
“I pointed out that I had been attacked at the hotel by the Party's new thug-in-residence, Randy Pollard, who launched an unprovoked diatribe against me. Pollard is drawing a Party paycheck while simultaneously serving in a conflict of interest situation as leader of the 'Clownty' Chairmen's Association. Pollard's conflicts were evident Thursday's fiasco.
“The judge appeared to be shocked and dismayed by Mark Kirk's tactics. He saw right through what they were doing. Some Republicans are trying to use bullying behavior to intimidate me from exposing Kirk in the primary election for what he is, a crooked congressman whose senate campaign is being fueled by liberal news media and corrupt campaign financing,” Martin said.
Martin expects to file his amended complaint seeking a freeze on Kirk’s campaign cash next week.
“It is very clear that Kirk is now trying to confuse voters and protect himself from meaningful campaign scrutiny by creating his own bogus 'bed sheet ballot' of opponents; Republican leaders have adopted a ‘clown show’ strategy, where anyone who claims to be a ‘candidate’--except me of course--is automatically allowed to speak and used to confuse voters with a ‘bed sheet’ list of ‘candidates.’
“This clown circus is Kirk's effort to cloak the primary in a plethora of frivolous ‘candidacies,’ so he will not face meaningful primary scrutiny. I believe Kirk’s tactic is going to backfire,” Martin says.
“Republicans refused to let me speak, Kirk's only opponent who has previously run statewide, and who carried or nearly carried 40 counties just last year, and received a quarter million votes:

U. S. SENATE CANDIDATE ANDY MARTIN WINS MAJOR SANGAMON COURT SETTLEMENT
(Springfield, IL)(August 20, 2009) Sangamon County Chief Circuit Judge Patrick Kelley agreed Wednesday to supervise a settlement between Republican U. S. Senate candidate Andy Martin and the Illinois Republican Party. Martin had sued the Party for discriminating against him in preparations for the Illinois State Fair.
An attorney for the Illinois Republican Party agreed to place Martin on the same basis with other senate candidates. The lawsuit alleged that Party employees had refused to deal with Martin’s representatives “on the advice of the Party’s attorneys.”
“Well the Republican Party’s lawyers were in court Wednesday,” Martin stated. “And they agreed to take back their advice to Party employees to stop dealing me with me and my supporters. We will have full participation at the Illinois State Fair.
“The Court agreed I had filed a proper lawsuit,” Martin said after the settlement was announced. “The judge conducted settlement negotiations in chambers, and we were able to achieve with the help of a judge what Party leaders refused to concede without a court case.
“It is unfortunate that party leaders put the court and the party through an unnecessary lawsuit.
“How party leaders can justify discriminating against a candidate that carried or nearly carried forty (40) counties last year, and won almost 35% of the statewide primary vote (240,000 votes), escapes me:

“The liberal news media and corrupt Associated Press are trying to pretend a candidate who carried 40 counties last year doesn’t exist. I consider that a compliment. Someone considers me a threat. That’s how they treated reformers in the old Soviet Union. They erased their existence.
“No other candidate has my credentials as a campaigner and as a corruption fighter. No one. I’m proud of my forty years of integrity and independence.

Senate candidate Andy Martin is creating a Green Beret-style “fighting camp” in Springfield to organize Wednesday’s and Thursday’s protests against his opponent “Infanticide Congressman” Mark Kirk.
“Rightly or wrongly, fairly or unfairly, conservatives do not feel welcome in the Illinois Republican Party,” Martin says. “Well they are now. My campaign is spearheading a ‘campaign within a campaign,’ to welcome conservatives ‘home’ and provide support for protests both Wednesday at the Pasfield House Inn and Thursday at the Illinois State Fair’s ‘Republican Day.’
“Wednesday we will have a 1:00 P.M. state court hearing to define our protest rights at the State Fair. Later Wednesday we will be protesting as fat cat Republicans munch on shrimp and champagne at the Pasfield House Inn. Thursday, we will be all over Springfield taking this message to the people of Illinois: conservatives are back, and conservatives have a real candidate for United States Senator.
“Conservative have been demoralized and disorganized by the disruptive tactics of liberal party leaders in Chicago. Andy Martin says Barack Obama has blundered again, abandoning “DOMA” in federal court
(CHICAGO)(August 18, 2009) I’ve never been married. And it’s not because I’m gay. Although my political views are conservative, my personal views are more accommodating. No, I wasn’t at Woodstock forty years ago, so you don’t have to listen to my Woodstock tales. But I wasn’t far away, either.
Despite never being married, I still believe in marriage. It is an ideal. And here’s a silly factoid. One of my favorite sections of the Sunday New York Times every week is the wedding announcements. One of my old girlfriends even made it into the big “Wedding of the Week” story some years ago. Nice person. I was very happy for her. I enjoy reading stories about people getting married.

As a constitutional scholar, I can assure you the FFCC is a very powerful part of our union and our jurisprudence. We created a union of states, but “full faith and credit” requires them to act on a united basis for most secular matters.
On the other hand, marriage and family law has always been the province of states, not Congress. We can look at DOMA as trying to address the conflicts between three spheres of our lives. In religion, churches should be absolutely free to recognize or not recognize marriages as they see fit. No one should tell a church whom to marry, or not to marry.
In our personal lives, we are free to believe what we believe.
My own beliefs are a mixture of conservative public policy and more liberal personal views.
Finally, there is the area of public morality and policy. Here, “conservatism” should be recognized as the touchstone of our social stability over the past 200 years. Just as the law protects the right to believe as we please, and protects the right of religions institutions to believe as they please, we should respect each other’s beliefs from state to state, and not impose New York’s social policies on Idaho, or Iowa’s on Alabama’s. The law is the sentinel of the Constitution.
DOMA is a compromise. And compromises often do not please everyone. They can’t. But DOMA protects the social and public policy diversity of our nation. It should be maintained and supported by the federal government. Obama is wrong to impose one rigid and uniform liberal social doctrine on the entire nation. His unwavering and relentless liberalism will be his undoing.
As for me, now that these remarks are finished and ready for distribution, I can catch up with my deferred reading, and start with the marriage announcements in last Sunday’s Times.

(CHICAGO)(August 18, 2009) I’ve never been married. And it’s not because I’m gay. Although my political views are conservative, my personal views are more accommodating. No, I wasn’t at Woodstock forty years ago, so you don’t have to listen to my Woodstock tales. But I wasn’t far away, either.
Despite never being married, I still believe in marriage. It is an ideal. And here’s a silly factoid. One of my favorite sections of the Sunday New York Times every week is the wedding announcements. One of my old girlfriends even made it into the big “Wedding of the Week” story some years ago. Nice person. I was very happy for her. I enjoy reading stories about people getting married.

Senate candidate Andy Martin against the Illinois State Fair and the Republican National Committee [hearing details below]. Martin has set a Chicago news conference for August 18th to explain his accusations.
Insurgent “Internet Powerhouse” Martin charges that the Republican Party is illegally denying him access to the RNC’s “Voter Vault” to thwart his corruption-fighting campaign for the U. S. Senate. Andy claims the Illinois Republican Party’s leadership is controlled by a corrupt bipartisan “Combine.”
Finally, Martin’s case, filed in Sangamon County Circuit Court, Springfield, Illinois, seeks a court order permitting his protesters at the State Fair’s “Republican Day” to reflect the split in the Illinois Party.
The Circuit Court hearing on Martin’s Verified Motion for a Temporary Restraining Order will lead off two days of conservative Republican Springfield-area demonstrations and confrontation by Martin and his supporters.
Wednesday evening Martin is expected to picket Springfield’s historic Pasfield House Inn where Republicans are meeting; Thursday will involve conflicts over “Republican Day” at the Illinois State Fair. "There are two Republican Parties in Illinois,” Martin says. “There are the Republicans who live and work on Main Street; conservatives who are raising families and struggling with the economy. And there is the ‘other’ Republican Party of wealthy business leaders, known as the bipartisan ‘Combine’ of corruption that controls the nominal machinery of the Party through dishonest members of the Republican State Central Committee.
“I represent Main Street Republicans; Mark Kirk is the candidate of the Daley Machine-dominated ‘Combine.’
“I am being harassed for exposing Republican, as well as Democratic, corruption in Illinois. But Republicans cannot win in 2010 by being two-faced about crooked government. Unfortunately National Chairman Michael Steel was elected Chairman with help from the ‘Combine.’
“I asked Steele to open the RNC’s Voter Vault database because the Illinois ‘Combine’ is denying me access. The Voter Vault is supposed to be available to Republican candidates on a nondiscriminatory basis. Steele and his counsel refuse to respond. They are kowtowing to the Combine-controlled faction of the Party.
“Likewise, the Illinois State Fair seeks to limit debate and confrontation on what the Fair calls ‘Republican Day.’ I managed to work out protest procedures with the Chicago Police Department on Chicago’s crowded streets and sidewalks without the need to file a lawsuit. The Illinois State Fair is trying to stifle political dissent on state-owned land. The entire State of Illinois is a racketeer influenced corrupt organization. Even the State Fair.
“As for Mr. Steele, he can blab about ‘reform’ all he wants; as long as he is keeping corruption-fighting candidates from accessing the Voter Vault, he is voting with the Chicago Combine and against the People of Illinois,” Martin charges. “The Voter Vault belongs to Republican candidates nationally; it should not be under the control of the corrupt ‘Combine’ in Illinois.”

The Plaintiff asks this Court to issue two (2) separate orders on an emergency basis: (1) a Temporary Restraining Order (“TRO”) barring the Illinois Department of Agriculture (“Agriculture”) or Illinois State fair (“ISF”) or persons acting under Agriculture/ISF from interfering with Plaintiff’s protests at the Illinois State Fair on August 20, 2009; (2) an Order to Show Cause (“OSC”) directing the Republican Party defendants to show cause why Plaintiff should not be granted access to the Republican National Committee’s (“RNC’s”) Voter Vault (“VV”). The TRO and OSC are independent of each other.
1. Factual allegations
The facts governing each of these issues are set forth in the attached Complaint.
A. With regard to the TRO, plaintiff has been in negotiation with Agriculture, but has been unable to reach a written agreement as to the terms and conditions for Plaintiff’s use of the Illinois State Fair Premises (“ISF”) for “Republican Day.”
B. As to the RNC issues, the VV is made available to Republican candidates. But because of the corruption and hostility of the Illinois Republican Party (“IRP”) to “reform Republicans,” the VV is not being made available to Plaintiff to harass him as a candidate for statewide office.
2. Legal standards
A. The legal standards governing a TRO are straightforward, see Wilson v. Hinsdale Elementary, 349 Ill.App.3rd 243, 810 N.E.2d 637, 642 (Court of Appeals, 2d Dist. 2004).
3. Argument
A. The TRO
a. Plaintiff is not seeking unrestricted access to the State Fair. He is seeking access on a specific day which the ISF has designated as “Republican Day.” Thus, the ISF itself has allowed and invited Republicans to attend. The essence of political parties going back to Jeffersonian days is that parties have factions. Plaintiff represents mainstream Republicans; the defendants represent “Combine” Republicans. The term “Combine” was coined to describe Republicans-cum-Democrats who exercise dictatorial political powers over Illinois government on a continuing basis, all of which power is lubricated with corruption, self-interest and political duplicity.
b. The TRO/ISF claims arise under 42 U.S.C. § 1983. If the ISF is going to specifically host a “Republican Day,” then it must make reasonable accommodations for conflicting factions in the Republican Party.
c. The ISF claims it has established a "protest area" at a great distance from the Director's Lawn, while some Republicans will be allowed to meet at the Director’s Lawn. Protests which are removed from the area of actual conflict are not protests at all; they are meaningless and hollow gestures which reflect unconstitutional abridgement of political speech.
d. Plaintiff was able to resolve a much more complex protest issue with the Chicago Police Department, without the need to file a lawsuit. Chicago’s streets and sidewalks are crowded and congested. But the CPD was able to accommodate Plaintiff. The ISF is sticking rigidly to vague rules which seek to render Plaintiff’s protest nugatory.
e. Likewise, one faction of the Republican Day crowd has already been granted use of sound amplification. Plaintiff only seeks to use his own sound amplification at a reasonable level. The “rules” of the ISF are vague and offer unfettered discretion on the ISF to control "sound devices." A grant of unfettered discretion to a state official is unconstitutional. Once again, the ISF is taking a wooden approach to resolving what should have been resolved without a lawsuit.
B. The OSC
a. The Republican Party (RNC) has crated a database called the VV. The VV is made available to Republican candidates, and has been made available repeatedly to Plaintiff’s political opponents, including defendant Mark Kirk.
b. Making the VV available to only one of a number of candidates may violate federal election law, which bars excessive contributions to a single candidate in a primary election, as well as Illinois election law, which may bar use of state funds for a single federal candidate. In addition, the VV has been made available on an unrestricted basis to Republicans. In the most recent statewide primary Plaintiff received almost 35% of the statewide vote, and carried numerous downstate counties.
c. The RNC defendants are seeking to sabotage Plaintiff’s campaign for federal office, and sabotage the rights of downstate voters in particular to be reached through information contained in the VV. Such action by the defendants is inequitable and unlawful.
C. The legal criteria for relief
a. “Certain and Clearly Ascertainable Right”
The defendants themselves have designated a special day as Republican Day. They have invited Republicans to protest, and then sought to render protest meaningless. Do they suggest there is only “one” Republican voice? Or a monolithic party? That is obviously an unreasonable belief under any circumstances. Having invited “Republicans,” the ISF has to accommodate all Republicans. Likewise, the VV has been made to Plaintiff’s opponents; he has the same right of access as his opponents.
b. “Inadequate remedy at law”
There is no adequate remedy for denial of First Amendment Rights. Likewise, the VV is a massive compendium that has been created to assist candidates such as Plaintiff. Because of the constraints of time and cost, it would be impossible for any candidate to duplicate the VV.
c. Irreparable injury
The issue of irreparable injury given that Plaintiff is a candidate for federal office and seeks to demonstrate on only one day, billed as “Republican Day” by the ISF itself, in the area of the Republican congregation at the Director’s Lawn, cannot seriously be questioned, Cooper v. Rockford Newspapers, 50 Ill.App. 3rd 250, 365 N.E.2d 746, 750 (Court of Appeals, 2d Dist 1995) citing Elrod v. Burns, 427 U.S. 347, 373-374, 96 S. Ct. 2673 (1976).
d. “Likelihood of success”
With all due respect, Plaintiff has an excellent likelihood of succeeding on his claims that (1) the ISF has vague and unconstitutional standards for political speech on specific days when the ISF itself invites political speech by scheduling a “Republican Day” and a separate ”Democratic Day,” Elrod. The actions of the RNC/IRP defendants are arbitrary, capricious and violate the rules of the RNC itself. Plaintiff is an intended beneficiary of the RNC’s rules and procedures for VV access. Plaintiff has complied fully with the VV procedural requirements.

During the course of a political campaign, candidates receive nasty comments from a variety of people; abuse comes with the territory.
Illinois Republican Andy Martin received an abusive e-mail from Eric Hall, the Republican County Chairman for downstate Christian County. Here is Andy’s response. (You can ask Mr. Hall for his own original comments.)

Dear Eric:
Unlike other candidates that might ignore you or be tempted to respond with nasty comments, I am mystified by your remarks.
Mr. McKenna prevents me from speaking at a Republican function at which my opponent is allowed to speak, and you blame — me?
Mr. McKenna tells my representative that I am not welcome at Republican Day at the State Fair, but my opponent is, and you blame – me?
Mr. McKenna provides voter vault access to my opponent, but not to me, and you call me a “meathead?”
You accuse me of being “just what the Democrats are looking for,” but McKenna’s family is the one that does millions of dollars of business with the Daley Machine and is a member in good standing of the bipartisan Combine that has destroyed the Republican Party in this state. And you attack me? Do you have your facts mixed up?
Democrats love it when we lie to ourselves. We lied to ourselves when we nominated an out-of-stater to run against Barack Obama in 2004, and saddled the entire nation with Obama's socialism.
We lied to ourselves again in 2006 when McKenna & Co. quietly tried to slant the primary, and we ended up with Topinka, who didn’t even break 40% of the statewide vote.
We lied to ourselves when we rigged the primary in 2008 and nominated a joke that couldn’t even break 30% statewide!
And you accuse me of being “just what the Democrats are looking for?” No sir, the Democrats are not looking for me; they already have found Andy McKenna and his trend line speaks for itself. Keyes-Topinka-Sauerberg. And now Kirk.
There is one thing the politicians in both parties in this state can’t stand: the truth. I speak the truth, and I have a record of always trying to speak the truth. Neither party leadership wants me, because I have been fighting corruption for forty years, not profiting from it. I fight corruption among both Republicans and Democrats.
I can’t promise to win in November 2010; but I can promise you an honest, hard-hitting race that will hold the Democrats to account and offer a reasonable conservative Republican alternative.
Why did Barack Obama attack me personally in 2008? Because my work in searching for the truth about him cost Obama millions of votes. How many votes did you cost Obama in 2008?
My indictment of Obama on Fox News is still regarded as the best explanation of why Obama was wrong for America. Just this last weekend, Obama tried to suppress Fox News’ efforts to replay my segment on television. Kirk held a secret, invitation-only Chamber of Commerce “town meeting” in Naperville last week. Media with cameras and recorders were barred. He is afraid to meet his own constituents. And Kirk advertises himself as a “warrior” who fought in two wars? Luckily for Kirk, “cowardice in the face of a constituent” is not yet a crime.
Kirk wants to criminalize the Internet; have you told your committeemen and neighbors that? I am sure that will sell well in Christian County. How many votes will you attract downstate by telling people Kirk wants to put people in jail who attack Obama on the Internet? Great guy, that Kirk. Maybe now you know why Kirk is Obama’s favorite Republican. [Hint: you better become one of Barry Obama’s “friends” on Facebook, or you just might be staring a federal indictment in the face.]
The liberal media love Mark Kirk. They have reason to. Maybe you love the liberal media?
Now you can see why I am mystified by your abusive remarks. This is the point in my memo where most people would be insulting you, but I will avoid the temptation. I am someone who can actually work with county chairman because I appreciate the difficult job you perform.
But you also have to trust the statewide primary process. In over forty years of Illinois political experience, Mark Kirk is the worst “establishment Republican” candidate in history. To paraphrase Capital One TV ads, which Christian County country club membership card is in your wallet?
I will only ask you a simple question: why are you supporting Mark Kirk and attacking his only legitimate opponent? Me. Why?

LETTER TO AN ILLINOIS REPUBLICAN COUNTY CHAIRMAN
During the course of a political campaign, candidates receive nasty comments from a variety of people; abuse comes with the territory.
Illinois Republican Andy Martin received an abusive e-mail from Eric Hall, the Republican County Chairman for downstate Christian County. Here is Andy’s response. (You can ask Mr. Hall for his own original comments.)

Dear Eric:
Unlike other candidates that might ignore you or be tempted to respond with nasty comments, I am mystified by your remarks.
Mr. McKenna prevents me from speaking at a Republican function at which my opponent is allowed to speak, and you blame — me?
Mr. McKenna tells my representative that I am not welcome at Republican Day at the State Fair, but my opponent is, and you blame – me?
Mr. McKenna provides voter vault access to my opponent, but not to me, and you call me a “meathead?”
You accuse me of being “just what the Democrats are looking for,” but McKenna’s family is the one that does millions of dollars of business with the Daley Machine and is a member in good standing of the bipartisan Combine that has destroyed the Republican Party in this state. And you attack me? Do you have your facts mixed up?
Democrats love it when we lie to ourselves. We lied to ourselves when we nominated an out-of-stater to run against Barack Obama in 2004, and saddled the entire nation with Obama's socialism.
We lied to ourselves again in 2006 when McKenna & Co. quietly tried to slant the primary, and we ended up with Topinka, who didn’t even break 40% of the statewide vote.
We lied to ourselves when we rigged the primary in 2008 and nominated a joke that couldn’t even break 30% statewide!
And you accuse me of being “just what the Democrats are looking for?” No sir, the Democrats are not looking for me; they already have found Andy McKenna and his trend line speaks for itself. Keyes-Topinka-Sauerberg. And now Kirk.
There is one thing the politicians in both parties in this state can’t stand: the truth. I speak the truth, and I have a record of always trying to speak the truth. Neither party leadership wants me, because I have been fighting corruption for forty years, not profiting from it. I fight corruption among both Republicans and Democrats.
I can’t promise to win in November 2010; but I can promise you an honest, hard-hitting race that will hold the Democrats to account and offer a reasonable conservative Republican alternative.
Why did Barack Obama attack me personally in 2008? Because my work in searching for the truth about him cost Obama millions of votes. How many votes did you cost Obama in 2008?
My indictment of Obama on Fox News is still regarded as the best explanation of why Obama was wrong for America. Just this last weekend, Obama tried to suppress Fox News’ efforts to replay my segment on television. You might have gotten an e-mail about the cover-up (I had nothing to do with the following sample e-mail or other similar e-mails circulating about the Fox News suppression):

Kirk held a secret, invitation-only Chamber of Commerce “town meeting” in Naperville last week. Media with cameras and recorders were barred. He is afraid to meet his own constituents. And Kirk advertises himself as a “warrior” who fought in two wars? Luckily for Kirk, “cowardice in the face of a constituent” is not yet a crime.
Kirk wants to criminalize the Internet; have you told your committeemen and neighbors that? I am sure that will sell well in Christian County. How many votes will you attract downstate by telling people Kirk wants to put people in jail who attack Obama on the Internet? Great guy, that Kirk. Maybe now you know why Kirk is Obama’s favorite Republican. [Hint: you better become one of Barry Obama’s “friends” on Facebook, or you just might be staring a federal indictment in the face.]
The liberal media love Mark Kirk. They have reason to. Maybe you love the liberal media?
Now you can see why I am mystified by your abusive remarks. This is the point in my memo where most people would be insulting you, but I will avoid the temptation. I am someone who can actually work with county chairman because I appreciate the difficult job you perform.
But you also have to trust the statewide primary process. In over forty years of Illinois political experience, Mark Kirk is the worst “establishment Republican” candidate in history. To paraphrase Capital One TV ads, which Christian County country club membership card is in your wallet?

1. Jurisdiction and venue
a. This court has general common law jurisdiction of the controversy.
b. Substantially all of the operative activity of the defendants concerning the facts of this lawsuit is centered in Sangamon County.
2. The parties
a. Plaintiff Andy Martin (“Plaintiff”) is a candidate for United States Senator. He is a world-respected Internet publisher and columnist, see e.g. ContrarianCommentary.com. Martin is Illinois’ most durable and independent corruption fighter (see www.AndyMartin.com) and has helped send corrupt politicians and judges to jail.
b. Defendant Michael Steele is the Chairman of the Republican National Committee (“RNC”) and the de facto senior decision-making authority on the RNC’s Voter Vault (“VV”).
c. Reince Priebus is the General Counsel to the RNC and a senior legal authority to Steele.
d. Defendant Republican National Committee is the national organization comprised of representatives from each of the fifty states, including Illinois, which owns the VV and ultimately controls access.
e. Defendant Andy McKenna is the Chairman of the Illinois Republican Party (“IRP”). For the past six (6) years McKenna has made himself an antagonist of Plaintiff by seeking to use and abuse his control over the IRP to harass Plaintiff. McKenna uses stooges such as Tolbert Chisum to manipulate and control pliable members of the IRP.
f. Defendants Curt Conrad and Joe Weiss are employees of the IRP.
g. Defendant Illinois Republican Party is an organization created pursuant to the Illinois Election Code and comprised of indirectly elected “committeemen” from each of Illinois’ congressional districts. The election procedure for the IRP committeemen is created pursuant to state law.
h. Defendant Thomas E. Jennings is the Director of the Illinois State Fair (“ISF”), which is operated by defendant Illinois Department of Agriculture, an Illinois state government agency.
i. Defendant Mark Kirk is a campaign opponent of Plaintiff and is engaged in an active civil, and possibly criminal, conspiracy with defendants Steele, Priebus, McKenna, Conrad and Weiss.
3. Factual allegations
a. The Voter Vault Controversy
A. The RNC has created the VV as a powerful election tool (see, e.g. Appendix pp. 1-6).
B. On or about July 30, 2009 Plaintiff’s representative sought access to the VV. (App. P. 9)
C. On August 5, 2009 Plaintiff sent defendant Conrad a formal request for VV access (App. Pp. 7-8).
D. Defendant Weiss sent Plaintiff a form to complete and Plaintiff completed the form and submitted it to the indicated fax number (App. 10-11).
E. Plaintiff heard nothing from the defendants, and on August 11,2009 defendant Conrad said he would "not be pressured into providing VV access.” (App. 12). VV access, of course, is time-sensitive. Conrad wants to delay Plaintiff’s access indefinitely.
F. On August 11, 2009, in light of Conrad’s intransigence, Plaintiff wrote to defendants Steele and Priebus seeking access. These defendants have not responded and are acting in concert and conspiracy with McKenna, Patrick Brady, and others who are subservient to McKenna.
G. Defendant Kirk is being given access to the VV, thereby conferring a very valuable, exclusive “contribution” to Kirk’s campaign in violation of federal election laws. McKenna seeks to make VV available to Kirk, but not to Plaintiff, to assist Kirk because of the hostility of Republican Party voters to Kirk’s extreme liberalism and support for gun control, infanticide and higher taxes through the Obama administration’s “cap and trade” statute.
b. The “Republican Day” Controversy
A. The ISF promotes a “Republican Day” the ISF.
B. Plaintiff was invited to participate in planning for the ISF and, as requested, sent a representative. (App. P. 16).
C. When Plaintiff’s representative appeared at the ISF on August 13th, Plaintiff has been advised by his representative that defendant Conrad said that Conrad was under orders to refuse to deal with Plaintiff or his representatives. In effect, Conrad invited Plaintiff and his supporters to perform a meaningless and burdensome act by driving to Springfield only to be insulted and turned away.
D. Conrad and McKenna are seeking to illegally use IRP funds to promote Kirk as the party’s candidate, when most Illinois Republicans despise Kirk and want nothing to do with him.
c. The “Illinois State fair” controversy
A. The ISF states that it recognizes the need to exercise constitutional freedom (App. p. 17) but then goes around and renders constitutional freedoms meaningless.
B. Plaintiff seeks to demonstrate in the vicinity of the IRP activity near the Governor's Lawn, not in some remote location.
C. The ISF seeks to quarantine Plaintiff and his supporters in an area which is remote from the Governor’s Lawn, thereby rendering his protest meaningless.
D. The ISF restricts “Broadcasting Devices,” (App. P. 18) but imposes no standards on the allowance of audio amplification. Plaintiff has two megaphones that he wishes to use. He has no idea if they meet criteria, or if written criteria exist at all, for the approval of devices. In effect, while claiming to recognize “protest,” the ISF renders protest virtually impossible through vague or nonexistent standards and coerced “demonstration” in remote areas having no connection to the targets of the actual protests.
4. Legal claim
a. The actions of the defendants are inequitable.
b. The Court has broad equitable powers to fashion equitable remedies directing the defendants to provide VV access to Plaintiff as well as barring secret support for Kirk.
5. Demand for judgment
a. Plaintiff seeks money damages as the Court or a jury may impose.
b. Plaintiff seeks any and all declaratory and equitable relief to which he may be entitled.
COUNT TWO
[CIVIL RIGHTS CONSPIRACY]
1-3. Plaintiff repeats and realleges ¶¶ 1-3 of Count One and further pleads:

a. The Illinois State Central Committee, also known as the IRP, is created under Illinois State law and is thereby a de facto state actor.
b. McKenna is using the IRP to contribute money indirectly to Kirk through behind-the-scenes assistance which is available to Kirk but not to Plaintiff.
c. McKenna’s conduct and Kirk’s conduct amounts to a conspiracy to violate the Illinois and United States Constitutions, and to rig a primary election with clandestine financial and operational support.

a. The ISF’s restrictions on devices violate the First Amendment. b. Plaintiff seeks to demonstrate in the vicinity of the Governor’s Lawn using megaphones and asks the Court to strike down the ISF’s restrictions on peaceful protests as overly broad and vague.
5. Demand for Judgment
Plaintiff seeks declaratory and injunctive relief striking down the ISF’s restrictions on the location of speech, and the manner in which speech may be communicated (through ”devices”).

b. The defendants’ ongoing activity is a classic case of prima face tort, because their activity would otherwise be legal and is characterized by a desire to retaliate against, and gratuitously injure and destroy plaintiff because of his honesty, integrity and reform political activity.

Republican U. S. Senate candidate and insurgent “Internet Powerhouse” Andy Martin will hold a Chicago news conference Saturday, August 15th to announce that he has sued the Republican Party for illegally denying access to the RNC’s “Voter Vault” to his corruption-fighting campaign for the U. S. Senate. Martin’s lawsuit also names as defendants the Illinois Republican Party and details a series of improper acts by party officials.
Finally, Martin’s case, filed in Sangamon County Circuit Court, Springfield, Illinois, seeks a court order permitting protests at the State fair’s “Republican Day” to reflect the split in the Illinois Party.
"There are two Republican Parties in Illinois,” Martin says. “There are the Republicans who live and work on Main Street. Then there is the ‘other’ Republican Party of wealthy business leaders, known as the bipartisan ‘Combine’ of corruption that controls the nominal machinery of the Party through dishonest members of the State Central Committee.
“I represent Main Street Republicans; Mark Kirk is the candidate of the Daley Machine-dominated ‘Combine.’
“I am being harassed for exposing Republican, as well as Democratic, corruption in Illinois. But Republicans cannot win in 2010 by being two-faced about corruption. Michael Steel was elected Chairman with help from the ‘Combine.’
“I asked Steele for access to the RNC’s Voter Vault database because the Illinois ‘Combine’ is denying me access. The Voter Vault is supposed to be available to Republican candidates on a nondiscriminatory basis. Steele and his counsel refuse to answer. They are bowing down to the Combine-controlled faction of the Party.
“Likewise, the Illinois State Fair seeks to limit debate and confrontation on what the Fair calls ‘Republican Day.’ I managed to work out protest procedures with the Chicago Police Department on Chicago’s crowded streets and sidewalks, without the need to file a lawsuit. The Illinois State Fair is trying to stifle political dissent on state-owned land.
“What’s wrong with this picture? The entire State of Illinois is a racketeer influenced corrupt enterprise. Even the State Fair.
“As for Mr. Steele, he can blab about ‘reform’ all he wants; as long as he is keeping corruption-fighting candidates from accessing the Voter Vault, he is voting with the Chicago Combine and against the People of Illinois,” Martin will state. “The Voter Vault belongs to Republican candidates nationally; it should not be under the control of the corrupt ‘Combine’ in Illinois.”

Republican U. S. Senate candidate and insurgent “Internet Powerhouse” Andy Martin will hold a Chicago news conference Saturday, August 15th to announce that he has sued the Republican Party for illegally denying access to the RNC’s “Voter Vault” to his corruption-fighting campaign for the U. S. Senate. Martin’s lawsuit also names as defendants the Illinois Republican Party and details a series of improper acts by party officials.

For the past six (6) years Andy McKenna, Chairman of the self-styled “Illinois Republican Party, has been harassing my political activity. Unfortunately for Mr. McKenna, since he took over the state party, the party’s public support has continued an accelerated downward slide. Mr. McKenna is poised for yet another round of electoral catastrophe in 2010.
In my opinion 2010 will be a good year nationally for Republicans; it will be another bad year in Illinois due to McKenna’s dirty tricks and corrupt leadership.
McKenna insists on trying to harass and abuse his political adversaries, instead of trying to create a fair and level playing field in the primary, so that all candidates will feel they have been dealt with impartially and be encouraged to support the primary winner.
Last week McKenna was present when his stooges introduced U. S. Senate candidates, and refused to introduce me. (I received 35% of the senate primary vote in 2008; we are running an aggressive campaign which you can follow by e-mail or on our blogs.) As I have indicated in a letter to Mr. McKenna, which is posted on my blogs, McKenna’s dirty tricks are killing Mark Kirk’s candidacy.
Last week I also requested access to the Voter Vault (“VV”) which is apparently maintained by the RNC.
Today I was told it may take a month to secure approvals, while my opponent already has access.
McKenna’s efforts to rig the primary risk running afoul of federal prohibitions on state party activity. McKenna may be trying to skirt federal laws, but there is growing evidence he is breaking federal law in using unlimited resources to back Kirk. To the extent McKenna abuses RNC assets to benefit Kirk, the RNC could also be at risk.
We are probably going to court in the next day or two to resolve potential harassment at Republican Day at the Illinois State Fair.
I wish we could find a mechanism to discipline McKenna’s harassment short of litigation. Ultimately, all of this squabbling is made unavoidable by McKenna’s abuses, but it also hurts the party in the long run. That’s why McKenna’s stewardship has been an unmitigated disaster.
I would like to request direct access to the VV for the State of Illinois, directly through the RNC, and not through any instrumentality under the supervision and control of Andy McKenna.
I know that many Beltway bandits think Mark Kirk is the stronger candidate, and I respect their right to a contrary opinion. Based on my long experience I think Kirk is going to explode and implode (nice trick that) if he wins the primary. With McKenna’s dirty tricks being used to support McKenna, Kirk is doomed.
Please advise me in writing by the close of business today whether, in view of Andy McKenna unethical and unlawful behavior, and relentless harassment of my campaign, the RNC will provide direct access to my campaign for the RNC’s VV.

Thank for you r e-mail and mailed invitation to participate in Republican Day at the Illinois State fair. I also sent Andy McKenna a letter about State fair participation; he has not answered.
It is my impression that McKenna & Co,. are going to try and promote Mark Kirk, and lock me out of any equitable participation in the primary process, including Republican Day at the State Fair. This is a great mistake.
We have already ratcheted up our antagonism to Kirk in response to McKenna’s petty slights and abuses.
Party voters will be turned off by a primary that appears locked and brokered by a handful of Kirk backers. Ironically, Kirk has the most to gain from an honest and open primary. If the primary is vitiated by a McKenna lockout of competing candidates, Kirk will have lost the general election in February 2nd.
Due to a lack of response to an e-mail I sent Pat Brady (who shares an e-mail address with his wife, according to the IRP in Chicago) I gather I am even unwelcome at a reception being held on the evening of the 19th.
What are they afraid of? Is Kirk that weak, that delicate, that subject to being undermined? May be.
Now to the State Fair.
1. What are the speaking arrangements for the statewide candidates? Are we going to see the same gig we saw last week in Chicago where Kirk was given a bogus title to avoid allowing his opponents to speak? Or the use of McKenna’s straw man candidate, Eric Wallace, who was allowed to speak? (We will shortly be filing a lawsuit over that event.)
2. I can’t have someone in Springfield on the 13th. If this is an artificial condition to lock out candidates, I’ll just have to deal with it. Unlike Kirk, who is the cronyism candidate, I am the insurgent candidate, so we operate a tighter ship. If you are going to allow candidates to participate in planning by phone or e-mail, please put me down for a speaking slot with the other senate candidates, as well as a place to distribute literature, etc.
3. I would also like to be considered for participation in the DuQuoin State fair.
I am willing to work with the IRP if the IRP conducts a fair and open primary process with no dirty tricks and no bogus endorsements by Tolbert Chisum. If not, we will have to assume a posture which I would rather avoid, but obviously cannot avoid if the events last week are any predictor of future action.
I stand on what I previously noted above. Mark Kirk has the most to gain from a primary that is perceived as fair, open and impartial. If you treat him like a hothouse flower, the voters will too.

What are they afraid of? Is Kirk that weak, that delicate, that subject to being undermined? May be.
Now to the State Fair.
1. What are the speaking arrangements for the statewide candidates? Are we going to see the same gig we saw last week in Chicago where Kirk was given a bogus title to avoid allowing his opponents to speak? Or the use of McKenna’s straw man candidate, Eric Wallace, who was allowed to speak? (We will shortly be filing a lawsuit over that event.)
2. I can’t have someone in Springfield on the 13th. If this is an artificial condition to lock out candidates, I’ll just have to deal with it. Unlike Kirk, who is the cronyism candidate, I am the insurgent candidate, so we operate a tighter ship. If you are going to allow candidates to participate in planning by phone or e-mail, please put me down for a speaking slot with the other senate candidates, as well as a place to distribute literature, etc.
3. I would also like to be considered for participation in the DuQuoin State fair.
I am willing to work with the IRP if the IRP conducts a fair and open primary process with no dirty tricks and no bogus endorsements by Tolbert Chisum. If not, we will have to assume a posture which I would rather avoid, but obviously cannot avoid if the events last week are any predictor of future action.
I stand on what I previously noted above. Mark Kirk has the most to gain from a primary that is perceived as fair, open and impartial. If you treat him like a hothouse flower, the voters will too.

“Infanticide” Congressman Mark Kirk faces ultimatum in Illinois primary
Illinois U. S. Senate candidate Andy Martin says Kirk’s dirty tricks will elicit a devastating response. Kirk’s efforts to rig the Republican primary and muzzle his opponents will boomerang and undermine the entire ticket in November 2010. Martin is preparing to confront Kirk at the Illinois State Fair, as the nation’s first primary on February 2, 2010 becomes increasingly contentious. Martin says state party chairman Andy McKenna is taking Illinois Republicans backwards. Republicans could not break 40% against crooked governor Rod Blagojevich in 2006; they could not break 30% in 2008. Martin attributes Republican losses to a corrupt Republican state party leadership.

Dear Andy:
I was deeply disappointed, but not surprised, at the shenanigans of your little munchkin “Chicago Young Republicans” Wednesday night. They have picked up all of your bad habits trying to rig elections and harass candidates. Maybe that could be your/their new slogan: “Chicago Young Republicans, Same Old Dirty Tricks.”
Ironically, we documented in writing that what took place would not take place. I will be filing a lawsuit shortly about the fraud involved in lying to a statewide candidate. And, as I said, we have the misrepresentations in writing. What would you expect with a chumbolone like Lee Roupas running the show (I don’t know the Greek word for chumbolone, but maybe John Kass will helpfully provide it)?
Because you are the State Chairman and you participated in the charade, I hold you fully responsible for Wednesday’s spectacle. Muzzling me as a candidate for U. S. Senator to promote my opponent, Mark Kirk, was a major blunder on your part. As a result of your dirty tricks, we are ratcheting up our attacks on Kirk.
While you apparently do not like to answer letters, I make it a practice to put matters in writing and on the record. Unlike Mark Kirk’s secret life, there are no secrets in my campaign.
So here are my three points:
First, you are killing Mark Kirk’s campaign. Your dirty tricks and your denigration of freedom of speech are going to result in a statewide uprising that is going to defeat Kirk in the primary. Republicans want a fair and open and above-board primary. The shabby behavior you manifested on Wednesday is unacceptable.
Your dirty tricks provoke and necessitate a harsh response: you are turning a campaign that should be based on debates over the issues into a battle over Kirk’s slimy behavior and your attempts to prevent an open primary. Kirk can run, but he can’t hide. His 10-year charade is over.
I don’t think a man with a secret life such as Kirk benefits from efforts to stage a secret primary on his behalf. My prediction: if you keep up what you are doing, you will defeat Mark Kirk in the primary.
If you conduct an honest and fair primary, and Mark wins fair-and-square, most Republicans will accept the outcome. I know I will. But no one will accept an outcome orchestrated by the kind of dirty tactics employed against me on Wednesday night or Tolbert Chisum’s abuse of his role as New Trier Committeeman in 2007. The choice to go dirty was yours; I feel you will regret it. I know Mark Kirk will.
Second, you have a history of killing Republican candidates. Mark Kirk would be the third. In 2006, your manipulation of the gubernatorial race nominated “Goofy Judy.” She could not even break 40% against a crook. Not a good showing. I understand Goofy Judy is trying to make a comeback. If she does, the left will use her to undermine whoever wins the current gubernatorial primary. It is time for Goofy Judy to go quietly.
In 2008, you rigged the primary and corrupted the State Central Committee with a bogus “endorsement” to harass my campaign. Your chosen man Sauerberg did not even break 30%. Republicans voted against their party.
In other words, from election cycle to election cycle, your handiwork knocked the party backwards 10% in public support. Don’t blame the Democrats. Rod Blagojevich was still in office. But Republican voters dropped by 10%. Not a good showing on your part.
Somehow, you never appear embarrassed at your failures. With a record such as yours, most people would resign and go into hiding. Still you labor on, using the same dirty tricks against me that have failed before.
Third, here is my suggestion and proposal. I will offer to debate your candidate, Marky Mark Kirk, on the issues, if you agree in writing to conduct a fair an open and impartial primary. That means no muzzling or abuse of my campaign, no bogus endorsements by Tolbert Chisum, and no other dirty tricks.
If he wins, Kirk has my support.
Your acceptance would have to be in writing, ratified by the SCC and enforceable in and at every Republican Party meeting, function, etc. It would be a blanket agreement. No exceptions. No Roupas loopholes.
You should start by announcing in writing that you are ensuring that all candidates will be treated equally and given equal time at the Illinois State Fair. Your failure to respond to this letter will be deemed an admission that you are contemplating more dirty tricks on Republican Day August 20th.
You should talk with your National Committeeman. Although I am not a fan of his, he was proffered as an experienced lawyer. Any competent lawyer would tell you that your dirty tricks are going to backfire and injure, not aid, your candidate.
If you continue to conduct a crooked campaign, the primary will only be phase one in a campaign to defeat Kirk in the general election. A crooked primary cannot yield an honest candidate. Just remember “29% Sauerberg.” Twenty-nine percent.
I would suggest that you respond by Monday, August 10th at 5:00 P.M. in writing and by fax to this offer. If I have not heard from you by then, I will take any and all appropriate steps to defeat Mark Kirk and to run you and your gaggle of perverted politicians out of the Republican Party. You have one foot out the door already; if you keep playing dirty with Republican candidates, the remaining foot will not remain inside much longer.
The choice is yours.
