Preliminary Statement
Illinois election law permits a variety of unsavory “petition” practices that are barred by federal law. For example, federal election law bars candidates and their campaign treasurers from acting fraudulently or seeking to conceal the true nature of their expenditures by using straw men to act surreptitiously on their behalf.
The practice of financial concealment is generically called “money laundering” and is a violation of federal law.
Some member of the defendant “Solo Family,” referred to as “Solo and Solo” below, appears to be acting as a surrogate for Candidate “X.” In the course of this litigation, Plaintiff will ascertain the identity of candidate X and substitute his or her name as a defendant in this lawsuit.
[COUNT ONE]
[MONEY LAUNDERING – CIVIL RICO]
1. Jurisdiction and venue
a. This court has jurisdiction to hear and determine the matters presented pursuant to People v. Lewis, 295 Ill.App.3rd 587, 693 N.E.2d 916, 920 (Ill.App. 2d Dist. 1998) citing Tafflin v. Levitt, 493 U. S. 455, 110 S. Ct. 792 (1990).
b. Venue is proper in DuPage County. The “Solo” defendants reside in DuPage County.
c. The Code of Civil procedure is to be “liberally construed” to protect the “substantive rights of the parties.” § 735 ILCS 5/1-106.
d. Both the Illinois Constitution and U. S. Constitutions protect the substantive right to be a candidate for federal office, although the U. S. Constitution reserves to the State of Illinois the ministerial duty of actually conducting federal elections.
2. Factual allegations
a. The parties
A. The Plaintiff
1) Plaintiff is a candidate for United States Senator in the February 2, 2010 general primary.
2) Plaintiff has filed petitions with the Illinois State Board of Elections (“SBE”).
3) As part of his pre-filing due diligence prior to filing this lawsuit, Plaintiff contacted Solo and Solo by Federal Express; the defendants have refused to respond to the circumstantial evidence that some unlawful activity is being conducted by one or more of them. Plaintiff has drawn an adverse inference from the silence of these defendants as permitted by Illinois law, see e.g. Gabriel v. Columbia National Bank, 228 Ill.App.3rd 240, 592 N.E.2d 556 (Ill.App. 1st Dist. 1992).
B. The defendants
1) On information and belief (“OIB”) Glen K. Solo is the only person listed as an owner/occupant at the address given by “Andrew Solo” to the SBE.
2) OIB the status of defendant “Andrew Solo” is currently uncertain because he is not listed in any public database as residing at the address that some person furnished to the SBE.
3) OIB Candidate “X” is the person, or campaign committee or Campaign Treasurer of Candidate X, who furnished the cash to Glen/Andrew Solo which was then laundered and paid to the SBE.
4) OIB the relationship between Solo #1 and Solo #2 is currently undefined, and they are referred to as “Solo and Solo” pending further pleading and discovery.
b. The Facts Giving Rise to This Lawsuit
A. On or about November 5, 2009, defendant “Andrew Solo” of “Solo and Solo” copied the nominating petitions of six (6) candidates for United States Senator, see group Exhibit A attached hereto, including Plaintiff’s petitions.
B. Illinois law permits “ambush” attacks on candidate petitions, as well as the use of nominees, pseudonyms, straw men and other deceptive political practices. Federal law prohibits bars these practices.
C. OIB Andrew Solo of “Solo and Solo” was obviously acting for someone else; Solo’s undisclosed principal furnished the consideration for Solo’s payment to the SBE.
D. The purpose of using a “straw man” such as “Andrew Solo” of Solo and Solo is create a layer of secrecy between the candidate who is planning dirty tricks, such as candidate “X,” and the public awareness of that candidate’s political machinations. Such secrecy is permitted by Illinois state law, but barred by federal law for federal candidates. Federal law controls in this state for federal elections.
E. OIB it also appears possible that Candidate “X” may have recruited unsuspecting or unsophisticated straw men to act on candidate X’s behalf, and that Solo and Solo are dupes or victims of candidate X. Obviously, until we know who paid Solo and Solo and these defendants are deposed, it is impossible to plead facts with definitive clarity.
F. OIB Candidate “X” is obviously planning harassment and ambush attacks on up to six (6) candidates for United States Senator, and seeking to disrupt and corrupt the Republican Party primary for that office.
G. OIB Plaintiff is an Illinois corruption fighter of over forty (40) years standing, who has successfully exposed and prosecuted corrupt individuals and public officials, including corrupt judges, including as the catalyst for the legendary “Operation Greylord.” Plaintiff has a moral duty to act, as well as a concrete personal interest in exposing the Solo and Solo/Candidate “X” fraud scheme.
3. Legal claim
a. Money laundering is unlawful as a civil offense pursuant to 18 U.S.C. § 1961 (1)(B), § 1964.
b. Money laundering is defined in 18 U.S.C. § 1956 (a) (1)(3) as a transaction designed “in whole or in part” to either “conceal…the source..of specified unlawful activity…” or “to avoid a transaction reporting requirement under State or Federal law.
c. Under Federal law, federal candidates are required to truthfully disclose the actual nature of their disbursements, and not to use pseudonyms or straw men or subterfuges to conceal the source and nature of their financial activity.
d. Had Candidate “X” simply disclosed his or her activity openly, we would not be in Court. Candidate X sought to conceal his or her activity by using “Solo and Solo” as “front men” for “X’s” activity. This pattern of prevarication constituted money laundering.
e. Candidate “X’s” activity constitutes prohibited activity under federal law even though the target of the fraud was an Illinois state agency and other federal candidates such as Plaintiff.
4. Demand for judgment
Plaintiff sues and demands judgment as follows:
a. A judgment that defendants Solo and Solo must disclosure the source of the cash used by one or both of them to purchase copies of candidate petitions from the SBE.
b. Full disclosure as to the manner in which Candidate “X” disbursed funds from his or her campaign account and paid Solo and Solo for their services and related activity.
c. Ancillary money damages in an amount not to exceed $50,000 on all counts, with the total recovery in this action from all defendants limited to $50,000.
d. Such other relief as may be necessary and proper to do complete justice between the parties.

1-2. Plaintiff repeats and realleges Paragraphs 1-2 of Count One and further pleads:

a. This Court has jurisdiction pursuant to Lewis, supra, and Levitt, supra, to permit Plaintiff to seek declaratory relief as to his right to full disclosure of the financial activity of Solo and Solo.
b. The controversy between Solo and Solo and candidate “X,” and Plaintiff, meets the requirements for entry of a declaratory judgment pursuant to § 735 ILCS 5/2-701.
4. Demand for judgment
Plaintiff sues and demands a declaratory judgment and injunctive relief as follows:
a. Declaratory judgment that Plaintiff is entitled to the identity of the person who furnished federal campaign cash to Glen/Andrew Solo and the manner in which said funds were disbursed to one or more of these individuals;
b. Ancillary money damages in an amount not to exceed $50,000 on all counts, with the total recovery in this action from all defendants limited to $50,000.
c. Such other relief as may be necessary and proper to do complete justice between the parties.

Senate candidate and insurgent “Internet Powerhouse” Andy Martin will hold a Chicago news conference Sunday, November 8th to announce that he is preparing to file a lawsuit Monday in DuPage County to force the disclosure of funding for the “Solo Crime Family.”
“Someone who claims to be named ‘Solo’ is laundering money for an undisclosed U. S. Senate candidate,” Martin says. “I had not planned to challenge anyone’s petitions myself, but the surreptitious action of someone, in financing a mystery-man ‘Solo’ to copy the petitions of six (6) senate candidates tells me we are looking at political dirty tricks.
“We have had to go to condition ‘red’ to protect against election fraud. Sunday afternoon I hired an election attorney to defend the electoral process from criminal activity.
“Attacks by someone directed at six campaigns, excepting Pat Hughes and Mark Kirk, raise obvious suspicions. I have been told who is behind this scam, but out of an abundance of caution I will sue the ‘Solos’ and use my best efforts to definitively ascertain which one of them is behind the criminal activity.
“Federal law is very different than Illinois law. Under Illinois law, virtually ‘anything goes.’ Under federal law, when a federal (e.g. U. S. Senate) candidate transfers money out of their campaign account to purchase State Board of Elections petition files, the expenditure for that service must be made directly and not through a nominee to conceal the candidate as the source of cash. Hiding the source of cash is money laundering.
“Federal disclosure requirements were mandated as a result of money laundering during the Watergate conspiracy.
“We now have a mini-Watergate on our hands. An unidentified campaign gave someone who claims to be ‘Andrew Solo’ a large sum of cash to copy petitions at the State Board of Elections. Who was the source of that cash? I contacted the Solos and they refuse to respond. I am entitled to assume from the Solos’ silence that there is criminal activity going on.
“The ‘Solo’ phone number I was furnished was (630) 963-4170 in case anyone wants to check for themselves.
“A candidate who will engage in criminal activity as part of the petition process, and recruit others to aid and abet in criminal activity by seeking to money launder expenditures through his associates, needs to be disclosed. Period.
“Sadly, it is obvious that Republicans are as prone to criminal activity in politics as the Democrats,” Martin said.

Senate candidate and insurgent “Internet Powerhouse” Andy Martin said today that he has begun an investigation into the operations of “Andrew Solo,” who uses an address at 3928 N. Park Street, Westmont, Illinois but who has no listed contacts at that address. “‘Andrew Solo’ may be an unlawful alias for Glen K Solo,” Martin said.
“Andrew Solo is obviously a straw man for someone,” Martin says. “He is spending thousands of dollars in cash to copy petitions. ‘Solo’ copied every candidate’s petitions except Patrick Hughes’ and Mark Kirk’s. A reasonable inference would be that Hughes or Kirk is behind ‘Solo.’
“If anyone knows anything about this mystery person, and wishes to assist our investigation, please let us know at our Chicago offices. We have located the name of the property owner, Glen K Solo, and have contacted him as part of our investigation.
“We will be working over the weekend to determine if Solo has broken any tax laws, or federal election laws by operating in cash, surreptitiously, on behalf of a federal candidate,” Martin said. “We may go to court in DuPage County to determine if Andrew Solo is an unlawful alias for Glen K Solo.
“Someone is trying to unlawfully influence the Republican primary election by surreptitiously spending thousands of dollars on copies of Republican candidate petitions. Mr. Solo is a front man, but not for long,” Martin said.

We have opened an investigation into whether “Andrew Solo,” which may be an unlawful alias for you or some other person, is violating federal election laws by seeking to conceal the source of cash used to purchase copies of nominating petitions from the State Board of Elections for five (5) different candidates.
We would like to hear from you upon delivery of this inquiry.
We are preparing to file a lawsuit to ascertain the identity of “Andrew Solo,” as well as the source of cash used by “Andrew” to purchase “Andrew’s” petitions.
Federal law mandates that campaign expenditures be made in the name of the candidate and only through the candidate’s campaign account, not through the subterfuge of cash transfers to third parties.
Since you have owned your home for 22 years you may be old enough to remember the Watergate conspiracy, where criminal charges were brought after efforts were made to use cash transactions to conceal the identities of persons who were trying to improperly influence a federal election.
It may be that you need to consult independent legal counsel.

We have opened an investigation into whether “Andrew Solo,” which may be an unlawful alias for you or some other person, is violating federal election laws by seeking to conceal the source of cash used to purchase copies of nominating petitions from the State Board of Elections for five (5) different candidates.
We would like to hear from you upon delivery of this inquiry.
We are preparing to file a lawsuit to ascertain the identity of “Andrew Solo,” as well as the source of cash used by “Andrew” to purchase “Andrew’s” petitions.
Federal law mandates that campaign expenditures be made in the name of the candidate and only through the candidate’s campaign account, not through the subterfuge of cash transfers to third parties.
Since you have owned your home for 22 years you may be old enough to remember the Watergate conspiracy, where criminal charges were brought after efforts were made to use cash transactions to conceal the identities of persons who were trying to improperly influence a federal election.
It may be that you need to consult independent legal counsel.

(CHICAGO)(September 12, 2009) DuPage County Republicans need to build and strengthen their party. The conservative base of the party is ageing and slowly eroding. Instead, DuPage County Chairman Dan Cronin is using his limited financial resources to promote one of the most liberal members of Congress in a sham “healthcare rally” today, September 12th. Does this make sense? None whatsoever.
DuPage Republicans are supposedly hosting a “healthcare rally” Saturday. My retort to Mr. Cronin: “You Lie!”
This event is not a "healthcare" rally. It is a crass attempt to unlawfully and improperly use DuPage GOP funds to boost the candidacy of my primary opponent Mark Kirk. If there is one thing people do not need right now it is another “healthcare rally.” We have been inundated with rallies, town hall meetings and every which kind of meeting about “health care” all summer.
So why is Dan Cronin assembling a crowd to, in his own words, call DuPagers to “rally around their leaders?”

I can understand why Cronin would want to promote Reps. Peter Roskam and Judy Biggert. Both represent DuPage County in Congress. But Mark Kirk? Kirk’s district is many miles away from DuPage County. The “healthcare rally” is really an illegal sham event designed to avoid reporting DuPage County GOP expenditures for Kirk as contributions to his senate campaign.
Cronin is trying to violate campaign laws by disguising a political contribution to Kirk as a “rally” for “healthcare.” Most DuPage Republicans despise Kirk; Cronin is trying to undermine that opposition by giving Kirk his own Cronin-orchestrated love fest. At party expense.
When contributors give money to the DuPage County Republican Party, they expect those contributions to be used to support conservative-to-moderate causes, not to rouge up extreme, pro-infanticide liberal Mark Kirk as a “conservative.”
Will Cronin’s gambit work? Are DuPage Republicans that dumb? I don't think so. But Cronin’s cynicism makes him unfit to lead the party. A leader who lies to his followers, and uses legerdemain to violate federal and state campaign laws, is not a leader at all. He is a gangster.
Has Cronin scheduled forums for gubernatorial or senatorial candidates? Nothing at all. He’s too busy for that. He’s too busy promoting one of the most liberal members of congress, Mark Kirk, to DuPage County Republicans as a “conservative.” Does Cronin think people are that gullible? Cronin’s contempt for DuPage County Republicans would justify his ouster.
Dirty politics is dirty politics whether practiced by Daley Machine goons or Cronin Machine goons.
Ironically, “coddling” Kirk is a sign of weakness. The attempt to buttress Kirk with bogus events is a sign that the Illinois GOP leadership is terrified I am going to knock him of in the primary. I carried almost forty counties in the statewide primary last year, and received almost a quarter of a million votes. I am within striking distance of defeating Kirk. Cronin and his cronies can’t deal with that.
Andy Martin? Isn’t he the corruption fighter that helped force a corrupt DuPage County Illinois Supreme Court justice off the court decades ago? Horrors. Ethics? If I win the primary, we will see the dawn of a new day. Illinois Republicans will be led by a real corruption fighter, with a real record, not phony “corruption fighters” such as Mark Kirk, who has never done anything in decades of professional politics to fight corruption anywhere anytime.

Senate candidate Andy Martin told a Wheaton, Illinois news conference Saturday, July 4th that he has adopted a new rallying cry for the Republican Party in 2010: “God Bless the USA; we won’t let Obama take it away.©” Martin also told the news conference he is a “common sense conservative.”
“With attribution, our new slogan is available for use by Republicans everywhere, and will tell people what we stand for,” Martin said. “We love the USA; we won’t let Barack Obama take it away from us with his socialist schemes and groveling to foreign dictators. America is worth fighting for, and it is worth fighting Obama for. We will defeat him at the ballot box in 2010”
Martin “rocked” the Wheaton Independence day parade. He chanted “God Bless the USA” along the mile-and-a-half parade route to a rousing response from parade watchers. Waving his hat and carrying a 5’ by 3’ banner, Martin told DuPage residents that he will stand by the USA in Washington.

Senate candidate Andy Martin told a Wheaton, Illinois news conference Saturday, July 4th that he has adopted a new rallying cry for the Republican Party in 2010: “God Bless the USA; we won’t let Obama take it away.©” Martin also told the news conference he is a “common sense conservative.”
“With attribution, our new slogan is available for use by Republicans everywhere, and will tell people what we stand for,” Martin said. “We love the USA; we won’t let Barack Obama take it away from us with his socialist schemes and groveling to foreign dictators. America is worth fighting for, and it is worth fighting Obama for. We will defeat him at the ballot box in 2010”
Martin “rocked” the Wheaton Independence day parade. He chanted “God Bless the USA” along the mile-and-a-half parade route to a rousing response from parade watchers. Waving his hat and carrying a 5’ by 3’ banner, Martin told DuPage residents that he will stand by the USA in Washington.

NEW COURTHOUSE CORRUPTION INVOLVING JUDGE BONNIE WHEATON
(CHICAGO)(June 30, 2009) DuPage County judicial candidate Fred Spitzzeri exploded with anger in a DuPage County Courthouse vestibule Tuesday, threatening U. S. Senate candidate Andy Martin with violence.
“Let’s just go outside and settle this ourselves,” Spitzzeri menaced. “You picked on the wrong Sicilian. You’re a pussy.” Spitzzeri then moved closer to Martin as though to indicate an imminent outburst of violence.
Spitzzeri’s “gangsta” exhibition came as new court filings revealed Spitzzeri and Circuit Judge Bonnie Wheaton have engaged in additional judicial corruption. “I was stunned to discover that the new comedy team of Wheaton-and-Spitzzeri was again meeting in secret in March,” said Andy Martin. “Fred cooked up yet another secret hearing with Bonnie. What a pair. And they wonder why people have disgust for the courts and contempt for lawyers.
“Fred’s vicious attack on me, all in the presence of another attorney who was a witness [Richard J. Nogal of Goldstine, Skrodzki] was amazing. Spitzzeri doesn’t know that I also have Sicilian ancestors, and the Spitzzeris were probably mopping floors for the Trigonas. One of the differences between myself and Fred is that he was brought up as a Chicago West Side hoodlum and I was raised in a proper environment, including Oxford University.
“Fred’s desire to ‘settle things’ in the courthouse garden with fisticuffs was as unprofessional as it was desperate. Mr. Spitzzeri and Judge Bonnie Wheaton have corrupted the administration of justice, and they have been caught in flagrante delicto. But I have been exposing crooked judges for over forty years; catching petty crooks in small-town courthouses is nothing new for me.
“My web site www.StopSpitzzeri.com portrays judicial candidate Spitzzeri as unstable and unsuccessful—and unscrupulous. The incident Tuesday shows that when confronted with the truth about his machinations, Spitzzeri dropped all pretense of his genteel Naperville demeanor and quickly reverted to his original persona as a violent Chicago crime syndicate hoodlum. Do DuPage voters want this man as a judge?” Martin asks.
“Spitzzeri should be banned from having DVD’s of the ‘Sopranos’ in his family room. He cannot distinguish fiction from reality.”

NEW COURTHOUSE CORRUPTION INVOLVING JUDGE BONNIE WHEATON
(CHICAGO)(June 30, 2009) DuPage County judicial candidate Fred Spitzzeri exploded with anger in a DuPage County Courthouse vestibule Tuesday, threatening U. S. Senate candidate Andy Martin with violence.
“Let’s just go outside and settle this ourselves,” Spitzzeri menaced. “You picked on the wrong Sicilian. You’re a pussy.” Spitzzeri then moved closer to Martin as though to indicate an imminent outburst of violence.
Spitzzeri’s “gangsta” exhibition came as new court filings revealed Spitzzeri and Circuit Judge Bonnie Wheaton have engaged in additional judicial corruption. “I was stunned to discover that the new comedy team of Wheaton-and-Spitzzeri was again meeting in secret in March,” said Andy Martin. “Fred cooked up yet another secret hearing with Bonnie. What a pair. And they wonder why people have disgust for the courts and contempt for lawyers.
“Fred’s vicious attack on me, all in the presence of another attorney who was a witness [Richard J. Nogal of Goldstine, Skrodzki] was amazing. Spitzzeri doesn’t know that I also have Sicilian ancestors, and the Spitzzeris were probably mopping floors for the Trigonas. One of the differences between myself and Fred is that he was brought up as a Chicago West Side hoodlum and I was raised in a proper environment, including Oxford University.
“Fred’s desire to ‘settle things’ in the courthouse garden with fisticuffs was as unprofessional as it was desperate. Mr. Spitzzeri and Judge Bonnie Wheaton have corrupted the administration of justice, and they have been caught in flagrante delicto. But I have been exposing crooked judges for over forty years; catching petty crooks in small-town courthouses is nothing new for me.
“My web site www.StopSpitzzeri.com portrays judicial candidate Spitzzeri as unstable and unsuccessful—and unscrupulous. The incident Tuesday shows that when confronted with the truth about his machinations, Spitzzeri dropped all pretense of his genteel Naperville demeanor and quickly reverted to his original persona as a violent Chicago crime syndicate hoodlum. Do DuPage voters want this man as a judge?” Martin asks.
“Spitzzeri should be banned from having DVD’s of the ‘Sopranos’ in his family room. He cannot distinguish fiction from reality.”

Martin calls Naperville Township trustee Fred Spitzzeri one of the most corrupt public officials in Illinois, and totally unfit to serve as a DuPage County judge. “Fred is not a ‘public’ official,” Martin charges. “He is a ‘private’ official, working to satisfy his own private greed and personal benefit.
“For the past two decades, Fred Spitzzeri has cultivated a public image as an amiable attorney, all while seeking to serve himself and his own pecuniary interests first, last and always. Behind the façade, Spitzzeri is pure ‘Daley Machine.’ The essence of the Daleys is to steal while no one is looking; that has been Spitzzeri’s modus operandi as a Naperville Township trustee.
“Our web site offers a detailed analysis of Spitzzeri’s unethical conduct and his documented record of trying to improperly influence sitting judges.
“Spitzzeri took a low-paying job as ‘township trustee’ and converted it into a gold mine for himself and his family, collecting over $90,000 in ‘benefits’ in his first term for a job that is supposed to pay a nominal $7,300 a year.
“DuPage Republicans are primarily middle class. Few are very wealthy and few are very poor. But they all work hard to pay their property taxes; they don’t want a parasite like Fred Spitzzeri enriching himself at their expense.
“We also caught Spitzzeri meeting secretly with Judge Bonnie Wheaton, and corrupting her, with brazenness and arrogance. Wheaton in turn said she was unaware that judges should not meet in secret with one side to a pending lawsuit. I do not want DuPage County to become a Republican mirror image of the Cook County Courthouse. I am committed to fighting for ethical judges in both Republican and Democratic counties.
“Republicans have only one thing to offer DuPage County and Illinois residents: honest government. But Spitzzeri’s behavior is a repudiation of everything Republicans are supposed to stand for. He undermines every Republican who is fighting for good government. Fred took an obscure job and converted the position into a personal gold mine with $90,000 of ‘honest graft;’ that kind of behavior is a classic Daley Machine technique.
“Over the past forty years I have exposed both Democrats and Republicans as crooks [see www.AndyMartin.com]. When it comes to fighting corruption, I am completely nonpartisan. As a statewide candidate I normally avoid becoming embroiled in local races. The only exception to that general rule is in elections where I am aware of candidates who are involved in corruption and abuse of public office. Mr. Spitzzeri should be Public Enemy #1 for DuPage County Republicans.
“The Spitzzeri scandal is also a salute to the Illinois Supreme Court. The Court recently reaffirmed the right of Illinoisans to a meaningful Freedom-Of-Information-Act. I used Illinois’ FOIA to obtain access to Naperville Township public records. My attacks on Spitzzeri are based on official Naperville Township archives.
“We will be working to defeat Fred Spitzzeri in the February, 2010 primary. He is unfit to serve as a circuit judge, unless he runs in Chicago where his type is welcomed. DuPage County is the last bastion of Republican strength in Illinois; Republicans should not jeopardize their dominant position in the county by allowing crud such as Spitzzeri to become judicial candidates,” Martin will state.
“Our investigation of Mr. Spitzzeri is continuing. Those with information or evidence to offer about Spitzzeri are invited to contact our offices.”
