APPELLANT’S NAME ON THE BALLOT PENDENTE LITE OR TO SUSPEND
THE PRINTING AND DISTRIBUTION OF GENERAL ELECTION BALLOTS
Pursuant to Local Rule 6 Appellant moves this Honorable Court to order the placement of his name on the General Election ballot, pendente lite or, in the alternative, to direct the State of Illinois and its subdivisions to suspend the printing and distribution of ballots.
I.
THE FACTS APPLICABLE TO THIS MOTION
A. Who is the Appellant?
The Appellant has been fighting corruption in Illinois politics for forty-four years, since he was a law student at the University of Illinois College of Law. He first gained some notoriety in 1968 when he exposed that Secretary of State Paul Powell was collecting bribes; Powell died shortly thereafter and left behind shoeboxes stuffed with cash.
It is axiomatic that someone who has devoted his entire .professional life to fighting corruption is highly unpopular in both the political and judicial spheres of Illinois.[1] And appellant is unpopular, precisely because he seeks to protect and vindicate constitutional rights and oppose the corrupt practices which are so prevalent in this state.
Nevertheless, it is precisely because Appellant is willing to fight for the Constitution that this Court should afford him some measure of respect.
B. What is the State’s strategy?
The Attorney General told the circuit judge that the state wanted new hearings before the State Board of Elections if the Appellant prevailed in court. In other words, the state wants hearings after the election is over concerning whether a candidate is qualified to run in already-conducted election. The political machine of Michael Madigan and his daughter Lisa Madigan is just as corrupt and odious as the political machine of Pat Brady and the Illinois Republican Party who are acting against Appellant.
The current “joke” in the media is that Madigan has chosen his own Republican to run against. See attached Chicago Tribune story. What the author John Kass leaves out is that the Republican Party is chiding Madigan to draw attention from its own corrupt shenanigans against Appellant and other candidates before the State Board, employing straw men, conduits and illegal payments under federal law.
Can it get any worse? Should appellant be ridiculed for trying to clean up the Illinois cesspool one campaign for office and one election at a time?
C. The Emergency
Every two years Illinois courts conduct “election litigation” while votes are being cast in the very election where the courts are reviewing the qualifications of candidates. This year is no different. The attached articles confirm that (i) votes are being cast and ballots are being distributed while Appellant and other new political parties are fighting to be on the ballot; and (ii) in an ultimate paean to absurdity, election officials hope that citizens will not cast votes because of the unsettled state of the ballot.
D. The Illinois judicial system as an institution is
delegitimized when it participates in the electoral charades and sham election litigation involving straw men, conduits and perjured testimony that have become a hallmark of the election process in Illinois
When a court allows itself to be a part of a charade, the court suffers as an institution. Citizens believe that Illinois politics are corrupt. To the extent that the courts participate in a corrupt process the courts ultimately and eventually lose legitimacy as impartial arbiters of constitutional rights and procedures.
There is no rational reason why Illinois should be unlike other states, almost all of which manage to avoid electoral litigation altogether by prohibiting straw men/conduit “objectors” and endless proceedings over ballot access, and which (ii) manage to resolve ballot issues before the ballots are printed and distributed, not after.
The current system of conducting Illinois elections serves the interests of corrupt public officials and corrupt political parties. Ipso facto, the system violates the U.S. Constitution as applied to candidates for federal office.
II.
LEGAL BASIS TO GRANT RELIEF
A. The Court has authority to award relief pendente lite
The Court has the authority to issue orders which protect the rights of the Appellant while the Court considers the unusual constitutional issues presented. And, after placing Appellant on the ballot pendente lite, the Court can always remove him nunc pro tunc if it later finds he should not prevail. But voters will be allowed to “cast their votes” on Appellant’s candidacy “at a meaningful time and in a meaningful manner.”
B. The Court owes a higher duty to federal candidates
State courts are presumed to be competent to adjudicate federal constitutional rights and enjoy concurrent jurisdiction, Taflin v. Levitt, 493 U. S. 455, 458, 110 S. Ct. 792 (1990).
Regrettably, federal courts have held that state and local candidates are entitled to less procedural and substantive protection in electoral disputes than candidates for federal office. But there is a principled constitutional basis for that distinction.
Federal candidates are created by the U. S. Constitution; their candidacies are supervised by federal election officials at the Federal Election Commission and U. S. Senate; state officials play a limited, ministerial role as to candidacies and even ballot procedures must conform to the higher standards of the U.S. Constitution and federal law. Thus the Court has a basis to order the placement of Appellant’s name on the ballot.
The Court certainly reserves the right to rule adversely to the Appellant a later date, but the Court will no longer be conducting serious constitutional litigation under the hydraulic pressure of voters who are literally voting in the election where Appellant is a candidate.
Ironically, if this Court were to take a strong stand against present practices and issue a favorable interim ruling in Appellant’s favor, the General Assembly might in the future amend the election laws to afford judges a more rational period of time to resolve election disputes before ballots are printed and voters start voting. The current system is “broken.”
This is the classic case in which to order relief because the decision of the circuit court is objectively illogical and absurd: the court ruled that despite a very explicit and detailed statutorily-mandated procedure for service of process created by the Election Code, the fact that the respondent State Board of Elections failed to serve the Appellant was irrelevant and meaningless. The Appellant was deemed to be “aware” of the proceedings because he fled a lawsuit protesting the lack of proper statutory-mandated service!
Nothing could be more calculated to make the Illinois courts look ridiculous than a ruling in which protesting you have not been served suspends the need for actual service of process.
As long as the Courts act in a supine manner and pretend to ignore the reality of what is going on, the charade will continue.

Senate candidate Andy Martin, whose “Bunker Buster” news conferences and political advertising earlier this year opened the door for national media to destroy the political career of Closeted Congressman Mark Kirk, will launch new attacks Tuesday on Kirk and the corrupt leadership cadre of the Illinois Republican Party.
On Saturday, Martin helped trigger massive demonstrations against Glenn Beck’s presence in Illinois on behalf of Pat Brady and other corrupt Republicans.
“There is a massive disconnect between ‘Illinois Republicans’ and the Illinois Republican Party,” Martin says. “Most Illinoisans who vote Republican are honest, hard-working, God-fearing citizens. They are pretty good conservatives. But the management of the ‘Illinois Republican Party’ is nothing but a bunch of crooks, led by Pat Brady and his sleazy staff, including legal masquerader Brien Sheahan.”
Brien Sheahan is the DuPage County Republican factotum who was engaged in a scandalous sexual relationship with a married Republican official; Sheahan reportedly got married recently to deflect rumors that he is gay.
“Most Republicans do not realize that when they contribute their precious, hard-earned money to the Illinois Republican Party, Pat Brady is siphoning off that cash to pay Brien Sheahan $35,000 a year for serving as ‘General Counsel,’” Martin notes. “John Fogarty, Jr. also profits from cash which contributors believe will be used to fight Democrats. Brady, Sheahan and Fogarty are looting the Republican Party for their own political and personal enrichment. The rest of the office staff of the Party is not much better, if at all.
“I am working on behalf of good Republicans, not the crooked cabal of ‘Republicans’ that is part of the bipartisan ‘Combine of corruption’ in Illinois politics.
“Monday Mr. Sheahan was caught in a lie, in open court, on a transcript. Sheahan told Circuit Judge Robert Bertucci that Sheahan had ‘not been served’ with Martin’s appellate materials. As required by state law, I was serving Sheahan’s ‘client,’ not Sheahan personally. Sheahan didn’t even know what the statute required. Sheahan’s confession was recorded on tape as well as being taken down by a court reporter.
“We now have conclusive evidence that Andrew Heffernan, who faces federal prison because of his fraudulent election affidavits and blatant perjury before the Illinois State Board of Elections, no longer communicates with Sheahan and Fogarty. Heffernan has belatedly realized that he is being used as a ‘chumbolone’ by the higher-ups in the Illinois Republican Party. Heffernan is committing the actual crimes, by lying abut his relationship to Sheahan and Fogarty as well as by lying about Heffernan’s real role as a stooge ‘objector’ for Illinois Republican Party leaders.
“What was the General Counsel of the Illinois Republican Party doing in court Monday claiming to act as the ‘attorney’ for someone who is supposed to be an independent ‘citizen objector?’ Obviously, Heffernan now realizes he has been used, and he could go to jail, while Sheahan collects $35,000 a year from the Republican Party for doing nothing. It is sleazy.
“But the real majordomo of sleaze in Illinois Republican circles is Mark Kirk, the ‘Closeted Congressman’ who is famous in Chicago’s ‘Boys Town’ for his escapades as a ‘gay blade’ in that neighborhood.
“Last year I told Pat Brady if he ran a crooked primary on behalf of Kirk, he and Kirk would pay for it this November. Brady ran a crooked primary, and they will be paying for it between now and November 2nd. Tuesday we drop the first ‘Bunker Buster.’ There are plenty more to come,” Martin says. “And the great thing: all of my evidence and accusations are truthful. Mark Kirk may face criminal charges in Navy fraud probe
U.S. Senate candidate Andy Martin says Illinois Chairman Pat Brady has destroyed the Republican Party and destroyed Mark Kirk by trying to rig the 2010 primary in Kirk’s favor. Martin blames Brady’s character assassination and dirty tricks for the negative campaign which has been generated by Brady’s underhanded leadership. Martin notes he warned Brady months ago to stop the dirty tricks, and Brady only increased his improper activity. Brady has endorsed Kirk, and Kirk has given the state party $50,000. Martin is preparing to “dial up” his attacks on Kirk with Bunker Buster ads #3 and #4.

Andy Martin says Pat Brady’s attempts to demonize and destroy Andy Martin have resulted in a blowback campaign which is destroying and demonizing Kirk
(CHICAGO)(January 7, 2010) Republican U. S. Senate candidate and insurgent “Internet Powerhouse” Andy Martin told a Chicago news conference Thursday evening, January 7th that he has filed charges against Mark Kirk with the Secretary of the Navy.
Martin’s accusations follow this release. Martin’s allegations involve both possible criminal conduct by Kirk and a “don’t ask, don’t tell” suggestion to the Navy Secretary. Martin expects Kirk to leave the Navy shortly to avoid investigation.
Martin blamed Illinois Republican Chairman Pat Brady for the dirty campaign that has developed.
“For the last year, Andy McKenna and Pat Brady have been sticking it to me with dirty campaign tactics and dirty politics. Well, now I am sticking it back to Brady and Mark Kirk. Brady endorsed Kirk and has tried to make the Republican Party an extension of Kirk’s campaign. Kirk in turn played the sleazy old Illinois game of ‘pay-to-play’ by trying to purchase the nomination with a $50,000 cash donation to the Party.
“For example, Brady locked me out of the Party’s ‘Voter Vault’ while giving McKenna and Kirk access. I was forced to waste time on lawsuits to obtain basic information. We are still in court. Kirk supporters tried to have me arrested at the State Fair. Someone has to be held accountable for these abuses.
“Brady smeared me on December 28th, but has never questioned or challenged Republican McCain majordomo Kevin DuJan who published a ‘secret plan’ by the Democratic Party to defeat Kirk through homosexual innuendos. Why was I ‘bizarre’ when the Republican Party was winning and dining DuJan, whose attacks on Kirk were much more graphic?
“Once again, Brady has proven to be a corrupt and—worse—incompetent leader. He tried to rig the dice in Kirk’s favor and only achieved a collapse of the casino.
“Last week, Brady tried to demonize and destroy me and to define my 40 years of honorable service to the people of Illinois through the warped prism of Brady’s support for Mark Kirk. I am compelled to destroy Kirk in return. I fight fire with fire.

I wish to file a two-part complaint against Mark Steven Kirk.
First, I wish to formally lodge a “don’t ask, don’t tell” complaint against Mr. Kirk. Although Mr. Kirk denies that he is a homosexual, the entire gay media world says that Kirk is gay. I find it hard to believe such a large and informed sampling of public opinion is wrong.
In addition, Mr. Kirk allowed the pedophilia of Mark Foley to continue in the House of Representatives for many years. Although there does not appear to be a clinical connection between homosexuality and pedophilia, the existence of potential multiple systems disorders may reflect a cumulative impact on Mr. Kirk's personality structure.
Second, I am fully aware, as you should be, of federal criminal laws which prohibit the use of Navy property and facilities for political campaigns. What Mr. Kirk has been doing for years is claiming he is on “reserve” status and heading for a Navy facility, where he claims to be “serving” instead of merely being on a congressional junket. Kirk claims to have fought in several wars, though I doubt he has ever been actively assigned to a combat area (he may have been in a generic “war zone” but not everyone in a war zone is in a combatant area).
What do Navy records reflect about Kirk’s service and whereabouts, in comparison with what he has claimed in his political campaigns? Voters and media have a right to know.
When a candidate for federal office makes an issue of his Navy service, the Navy cannot cover-up conflicting or contradictory records. How did Kirk get to Afghanistan this month? His travel records are obviously readily available and totally unprivileged materials. Please release all of them on FRIDAY, January 8th.
What did Kirk do there? Who guarded him? Where did he stay? These are questions that are put in play by Mr. Kirk's pre-programmed political speeches which he scheduled prior to leaving the country and which he is now delivering after his return from a “combat” zone.
I have asked Mr. Kirk to waive any privacy rights he may have and he has refused. Kirk wants to have it both ways, making exaggerated claims that he is “fighting” while barring any public access to actual Navy records which document his presence overseas. This legerdemain must stop.
Most respectfully I demand that you take personal command of this scandal and personally see to the release of the full record of Mr. Kirk’s alleged most recent trip to Afghanistan. I want no more double-talk and delays in releasing documents from the Navy. The Navy is aiding and abetting Kirk in perpetrating a military masquerade.
Kirk has effectively waived any privacy issues by making a big political issue of his “fighting for freedom in Afghanistan” today, and repeatedly using Navy photographs in his campaign materials. Personally, I doubt Kirk was anywhere near hostilities. Kirk cannot be allowed to use his status as a Navy officer as a prop to campaign for political office. His behavior is disgraceful, and most likely criminal.
This is not the first time Kirk has used DOD premises for political promotion. This abuse of the Navy and DOD must STOP. Serving in the reserves is intended to enhance the service, not to provide a platform for masquerading military pretenders such as Kirk to drop in on Navy facilities “on active duty” for the purpose of having Navy photographers take pictures for use in his political brochures and pamphlets.
I respectfully request that you immediately do the following:
1. I ask that you immediately release all Navy Department records concerning Kirk’s latest trip to Afghanistan, and all prior trips as well since 2001 when Kirk entered the U. S. House. Do so this WEEK. Voters have a right to the truth about Kirk. NOW. His travel appears to have been a series of transparently political junkets and did not involve any material “active duty” whatsoever.
2. I ask that you open a "don’t ask, don’t tell" investigation. There is sufficient circumstantial evidence to support an independent investigation by the Navy.
3. I ask that you notify the U. S. Attorney for the Eastern District of Virginia of Mr. Kirk’s apparent criminal activity. The claim that Kirk is on active duty as he flies around foreign bases, when he is in fact only politically profiteering at taxpayer expense and with the Navy's connivance, active or passive, is criminal behavior.
The hundreds of thousands of brave patriots who serve Americans in uniform are being used by Mr. Kirk as his political props. He has done this over and over again in the past. Now that I am his opponent I intend to stop this use, misuse and abuse of uniformed service personnel to support Mr. Kirk’s personal political campaigning.
Mr. Kirk should be separated from the service at the earliest opportunity consistent with due process of law.

(CHICAGO)(January 7, 2010) Republican U. S. Senate candidate and insurgent “Internet Powerhouse” Andy Martin told a Chicago news conference Thursday evening, January 7th that he has filed charges against Mark Kirk with the Secretary of the Navy.
Martin’s accusations follow this release. Martin’s allegations involve both possible criminal conduct by Kirk and a “don’t ask, don’t tell” suggestion to the Navy Secretary. Martin expects Kirk to leave the Navy shortly to avoid investigation.
Martin blamed Illinois Republican Chairman Pat Brady for the dirty campaign that has developed.
“For the last year, Andy McKenna and Pat Brady have been sticking it to me with dirty campaign tactics and dirty politics. Well, now I am sticking it back to Brady and Mark Kirk. Brady endorsed Kirk and has tried to make the Republican Party an extension of Kirk’s campaign. Kirk in turn played the sleazy old Illinois game of ‘pay-to-play’ by trying to purchase the nomination with a $50,000 cash donation to the Party.
“For example, Brady locked me out of the Party’s ‘Voter Vault’ while giving McKenna and Kirk access. I was forced to waste time on lawsuits to obtain basic information. We are still in court. Kirk supporters tried to have me arrested at the State Fair. Someone has to be held accountable for these abuses.
“Brady smeared me on December 28th, but has never questioned or challenged Republican McCain majordomo Kevin DuJan who published a ‘secret plan’ by the Democratic Party to defeat Kirk through homosexual innuendos. Why was I ‘bizarre’ when the Republican Party was winning and dining DuJan, whose attacks on Kirk were much more graphic?
“Once again, Brady has proven to be a corrupt and—worse—incompetent leader. He tried to rig the dice in Kirk’s favor and only achieved a collapse of the casino.

(CHICAGO)(November 10, 2009) Republican U. S. Senate candidate and insurgent “Internet Powerhouse” Andy Martin condemned Patrick Hughes for attacking other senate candidates. Tuesday Martin offered free assistance to candidates who are being attacked by Hughes at the State Board of Elections.
During the 2004 election cycle, Martin assisted Norm Hill at the State Board of Elections and secured a place on the statewide primary ballot for Hill.
“I am not a practicing attorney,” Andy Martin says, “just a humble law professor. But the State Board of Elections rules allow me to assist candidates whose petitions are attacked. The action of Patrick Hughes, ‘chumbolone candidate for senator,’ in attacking two other senate candidates, is disgraceful.
“State Chairman Pat Brady said he was against dirty tricks, but Brady is curiously silent in the face of Hughes’ antics. It looks as though Brady is selectively enforcing his ‘rules’ for honest campaign conduct.
“Hughes may be the stupidest and most incompetent candidate in recent history. First Hughes bragged that he wanted to file ‘last,’ to be in last place on the ballot. Then Hughes’ campaign flubbed his petition filing, losing last place and creating new drama over fouled-up petitions and confused status. Is this guy for real, or what?
“When Hughes fumbled his own strategy after bragging what a genius he was, Monday he tried to correct his mistake by attacking two other candidates who filed for senator after him. Hughes’ behavior is a disgrace to the entire Republican Party. The only petition challenges that were apparently filed at the statewide level in the Republican Party were filed by Hughes, who did not even vote in a Republican primary until 2008! What a jerk.
“My staff is preparing action to confront so-called ‘Christian leaders’ who endorsed Hughes in a smoke-filled room last summer. Initially there were nine (9) conspirators, but they had shrunk to six (6) by October. Any so-called ‘Christian’ or ‘family leaders’ that continue to endorse a candidate such as Hughes, who engages in campaign dirty tricks, disgrace Christ and disgrace his or her pro-family organization. We will have more to say on this topic Wednesday.
“Radio personality Sandy Rios should also reconsider her support for a malicious candidate such as Hughes. Hughes makes Rios look bad.
“In the meantime, I offer my services for free to any statewide candidate who was attacked by Hughes. Norm Hill is a very satisfied 'client;' we got him on the ballot in 2004.
“I would rather the Hughes victims hire a private attorney if they can afford it. But if not, my services are pro bono. Free. I am a believer in democracy and a ‘Defender of Democracy.’
“Hughes did not even have the guts to own up to his dirty deeds. He used a senior citizen in Lake County, Raymond True, as a straw man. When my campaign takes any action, my name is on the line. I don’t use senior citizens as straw men to conceal my agenda. It looks like Raymond True of Lake County is a dupe of Patrick Hughes. People can trust me to stand behind my campaign. I don’t hide behind straw men, third parties and subterfuges.
“Republican voters can trust my name on the state ballot.
“I believe that candidates who spent months slogging across the state, and months collecting signatures, should be allowed to run. I don’t think a sleazy attorney such as Pat Hughes should be allowed to rig the electoral process to remove his opponents with spurious challenges because he afraid to face them at the ballot box. Patrick Hughes is an enemy of Christians, an enemy of Republicans and an enemy of democracy,” Martin said.
Martin is contacting Robert Zadek and Thomas Luna to offer his free services at the State Board if either man needs assistance defending against Patrick Hughes' petition attacks.
“What Patrick Hughes did was not the Christian thing to do. Why are his so-called ‘Christian leader’ supporters so silent? Jesus would spit on them for their gross hypocrisy.”

Dear Pat:
None of us is perfect in life, and all of us have flaws. We all make occasional mistakes and misstatements. My opponents, for example, like to attack me for things I allegedly said twenty-five years ago. They can’t find anything more current to criticize. So I am writing this letter not as someone who is perfect, but as a candidate who always tries hard to do the right thing.
Pat Hughes is becoming a major embarrassment to the Republican Party, not just to himself.
The Illinois Republican Party has adopted a Campaign Code of Conduct. That Code is biding on “all candidates seeking the Republican nomination for federal,…office.”
Hughes lied when he said Mike Ditka had “endorsed” him as a candidate. Ditka, who is beloved by many in Illinois including me, was forced to disown and repudiate Hughes’ untrue claim.
Hughes lied again when he said Ditka was serving on Hughes’ Finance Committee. Ditka disowned and repudiated that statement as well.
What makes Pat Hughes lie, and lie over and over again? Is it because he has no record of political or public accomplishments, and feels compelled to lie about imaginary endorsements? I don’t have the answer. Do you?
You were in Springfield with me on August 29th when Hughes said he had “$400,000” in financial commitments. The money vanished. The obvious implication: Hughes lied again.
How can Republicans seriously consider a habitual liar for a statewide nomination?
Hughes also created an ongoing ruckus when he bribed so-called “Christian leaders” to secretly endorse his candidacy. He lured other, unsuspecting, candidates to bogus “forums” which were nothing more than a sham created to endorse Hughes and no one else. Another violation of the Code: "I will not undertake or condone any dishonest..."
Hughes recently asked two victims of his campaign fraud to
“withdraw” as candidates. He didn’t pick the candidates with
the lowest public support. He singled out the African-American
candidates and demanded they withdraw. What a way to run for
office: lying to the public and attacking African-Americans.
That violated the “full and equal participation in the electoral
process” provision of the Code.
You need to have a man-to-man talk with Hughes and ask him to
avoid any further embarrassment to the Republican Party. He
needs to step down to spend more time with his family. And maybe
a therapist.
We are the Party of Lincoln, and we are the party with a long
tradition of honest government. None of us is perfect, and I
I would be the last one to throw the first stone. But
neither I nor you can blind ourselves to Hughes habitual lying.
It’s out there for everyone to see.
How can any “Christian” support a candidate who habitually bears “false witness?”
You are an attorney, and I am a former adjunct professor of law. Hughes is also an attorney, though based on his current behavior you have to wonder what kind of an attorney he was. Attorneys are held to a higher standard than lay persons.
When an attorney who is seeking public office blatantly lies
about nonexistent endorsements he gives the legal profession a bad reputation. That is why it is imperative that you, as state party Chairman, take decisive action to bring down Pat Hughes’
embarrassing charade as a candidate. In a twist on the timeless words of Joe Louis, Hughes can “run,” but he can’t hide--from his own lies.
Ultimately, if you say and do nothing to stop Hughes, he makes you look bad. Enough said.

Ditka’s Restaurant in Chicago faces picketing and boycott starting Thursday, October 15th

(CHICAGO)(October 12, 2009) Republican U. S. Senate candidate and insurgent “Internet Powerhouse” Andy Martin announced today, Monday October 12th, that he would launch a boycott and picketing of Mike Ditka’s Restaurant in Chicago on Thursday, October 15th.
“It is disgraceful that NFL Hall of Famer Mike Ditka has allegedly endorsed Pat Hughes, a candidate for U. S. Senate who is anti-labor and anti-Black. How does Mike explain his bizarre behavior to his NFL colleagues?
“Last week Pat Hughes, who claims he has been endorsed by Ditka, told African–Americans to leave the U. S. Senate primary. This blatant act of racism has overtones of the Ku Klux Klan.
“I have a lifetime of support for civil rights, and I unhesitatingly condemn Pat Hughes for suggesting Blacks are unwelcome in the Republican Party.
Hughes’ ‘closeted’ adviser D. Paul Caprio is a disgrace to the Christian Conservative movement. Hughes’ recent demand, issued by Caprio, that Blacks exit the U. S. Senate primary was based on a bogus ‘commitment’ that Caprio claims candidates gave him last summer.
In reality, Caprio’s entire ‘conservative leader’ operation was a financial scam designed to personally enrich Caprio and to impoverish the credibility of the Christian movement in Illinois.

“It is disgraceful that NFL Hall of Famer Mike Ditka has allegedly endorsed Pat Hughes, a candidate for U. S. Senate who is anti-labor and anti-Black. How does Mike explain his bizarre behavior to his NFL colleagues?
“Last week Pat Hughes, who claims he has been endorsed by Ditka, told African–Americans to leave the U. S. Senate primary. This blatant act of racism has overtones of the Ku Klux Klan.
“I have a lifetime of support for civil rights, and I unhesitatingly condemn Pat Hughes for suggesting Blacks are unwelcome in the Republican Party.
Hughes’ ‘closeted’ adviser D. Paul Caprio is a disgrace to the Christian Conservative movement. Hughes’ recent demand, issued by Caprio, that Blacks exit the U. S. Senate primary was based on a bogus ‘commitment’ that Caprio claims candidates gave him last summer.
In reality, Caprio’s entire ‘conservative leader’ operation was a financial scam designed to personally enrich Caprio and to impoverish the credibility of the Christian movement in Illinois.

(CHAMPAIGN-URBANA)(October 9, 2009) Republican U. S. Senate candidate and insurgent “Internet Powerhouse” Andy Martin will hold an Urbana news conference today, October 9th to slam “incompetent and ineffective statewide Republican Party leadership.”
In a letter to State Party Chairman Pat Brady and Illinois Senate leader Christine Radogno, Martin says the failure to actively recruit a candidate for the 52nd Illinois Senate District is pathetic. The Republican Party is a classic example of a dying institution, Martin charges, due to the mendacity of the party’s statewide leadership.
“I saw Tom Kacich’s column on the vacant 52nd district and I said to myself ‘What are Brady and Radogno doing, if they are not recruiting a full slate of candidates?’ That’s the first duty of a party leader. How do they expect to win the 2010 election with vacant districts?” Martin asks.
“In over forty years of political involvement I have never seen more worthless political leadership. Other than trying to undermine my campaign, I fail to see that state party leaders are doing anything to rebuild the downstate counties. Last year they left a congressional seat vacant.
“I am claiming effective working control and leadership of the downstate Republican Party. In an open letter to downstate Republicans I offer to help them recruit candidates and do whatever else they ask me to do. I will do whatever downstate Republicans ask me to do. We need to field a full slate of candidates. We need to organize for victory, not just count our chickens before they hatch.
“I hate to quote Woody Allen, but he did say ‘Eighty percent of success is showing up.’ How can we be successful as a party if we do not show up with a full slate of candidates?
“The Daley Machine always fields a full slate of candidates, even in hopelessly Republican areas. As a result, the Machine continues to erode Republican strength in suburban areas and exert a stranglehold over the city. A properly led Republican Party would have a candidate for every state legislative district across the state, period.
“I have a downstate background, and I enjoy working with downstaters. Downstate has been abandoned by the Chicago-based Republican Party leadership. I know Illinois begins at Interstate 80; it doesn’t end there as some Republicans believe. My campaign’s resources are available to downstate Republicans for any assistance they deem appropriate.”

The 52nd Illinois senate district is a winnable Republican seat. Yet local media perceive no active efforts on your part to fill this vacancy. Why?
The first duty of party leaders is to field a full slate of candidates. Or, as Woody Allen says, “Eighty percent of success is showing up.” Even a “good year” in 2010 will be meaningless if we fail to field a full slate of candidates.
The future of the people of Illinois is in jeopardy. If Democrats get to redistrict, the Republican Party will become a tiny minority.
I have watched the Daley Machine erode Republican strength in Cook County. It has taken decades, but the Machine is making steady inroads with every election. The Machine fields candidates in every district, not just the winnable ones. Republicans need to do the same. Every General Assembly district should have a Republican candidate. Two weeks before petitioning ends, nothing is being done to fill slates. That is inadequate leadership.
As near as I can tell, you have virtually abandoned the downstate areas. That is why I am offering to fill the gap. I am offering my campaign resources to local downstate areas. Local leaders still need the benefit of statewide resources. My campaign will make them available.
Please feel free to contact me if I can be of assistance. In the meantime, I would like to see the 52nd district seat filled with a Republican candidate before petitioning ends.

2010 could be good year for Illinois Republicans. Maybe. We can’t win if we don’t show up. The 52nd Illinois Senate District (I am a candidate for U. S. Senator, not Illinois Senate) has no Republican candidate. The 52nd is a long-time Republican seat. Why forfeit?
Normally U. S. Senate candidates do not provide resources to local campaigns. But in view of the moribund state of Republican leadership, my campaign is available to serve downstate areas, in fact any areas of the state.

Dear Pat and Christine:
The 52nd Illinois senate district is a winnable Republican seat. Yet local media perceive no active efforts on your part to fill this vacancy. Why?
The first duty of party leaders is to field a full slate of candidates. Or, as Woody Allen says, “Eighty percent of success is showing up.” Even a “good year” in 2010 will be meaningless if we fail to field a full slate of candidates.
The future of the people of Illinois is in jeopardy. If Democrats get to redistrict, the Republican Party will become a tiny minority.
I have watched the Daley Machine erode Republican strength in Cook County. It has taken decades, but the Machine is making steady inroads with every election. The Machine fields candidates in every district, not just the winnable ones. Republicans need to do the same. Every General Assembly district should have a Republican candidate. Two weeks before petitioning ends, nothing is being done to fill slates. That is inadequate leadership.
As near as I can tell, you have virtually abandoned the downstate areas. That is why I am offering to fill the gap. I am offering my campaign resources to local downstate areas. Local leaders still need the benefit of statewide resources. My campaign will make them available.
Please feel free to contact me if I can be of assistance. In the meantime, I would like to see the 52nd district seat filled with a Republican candidate before petitioning ends.

Dear Illinois Republican:
2010 could be good year for Illinois Republicans. Maybe. We can’t win if we don’t show up. The 52nd Illinois Senate District (I am a candidate for U. S. Senator, not Illinois Senate) has no Republican candidate. The 52nd is a long-time Republican seat. Why forfeit?
Normally U. S. Senate candidates do not provide resources to local campaigns. But in view of the moribund state of Republican leadership, my campaign is available to serve downstate areas, in fact any areas of the state.
We will do whatever you ask us to do. Together, let’s set a goal to have a Republican file for every seat in the General Assembly, both Senate and House, even in overwhelmingly Democratic areas.
If you need my campaign’s help, just ask. Together we can recruit candidates, and regroup and rebuild the Illinois Republican Party. If the so-called “state party leaders” won’t pay attention to downstate communities, I will.
Pick up the phone. Let’s start working together. Let’s be prepared for victory in 2010, not just expecting a windfall.

(CHICAGO)(October 8, 2009) Republican U. S. Senate candidate and insurgent “Internet Powerhouse” Andy Martin will hold a Chicago news conference today, October 8th to condemn Republican “slime balls” D. Paul Caprio and senate candidate Patrick Hughes for attacking African-American candidates in the Republican Party and seeking to remove them from the primary ballot.
“A few days ago, Hughes attacked unemployment compensation,” Martin says. “Now he demands that Black candidates withdraw from our statewide primary. Caprio and Hughes are a disgrace to Illinois Republicans. "
Martin says Caprio and Hughes are creating a “hostile environment” for Black participation in the Republican Party. Martin is a long-time supporter of civil rights and spoke of the need for Republicans to support civil rights at the Coles County Republican Dinner on October 1st.
“I call on Republican State Chairman Patrick Brady to condemn these actions by Caprio/Hughes or face a civil rights lawsuit from my campaign. I will not tolerate blatant racism in the Illinois Republican Party," Martin says.
“I have been working hard as a candidate to welcome, invite and recruit African-American participation. I find it bizarre that the so-called ‘Jesus wing’ of the Republican Party is supporting blatant racists such as Caprio and Hughes. There is no place for Ku Klux Klan tactics in the Illinois Republican Party. Either Brady shows leadership, or I will lead him into a courtroom.
“Caprio/Hughes’ demand that Black candidates withdraw from the U. S. Senate primary is racist and irrational.
“Caprio/Hughes do not owe just Blacks an apology; they must apologize to every Republican for seeking to single out African-American candidates for denial of the right to run. The ‘right to run’ is a constitutionally protected right.
“I have previously condemned efforts by so-called 'conservative' party leaders to discourage people from running for office. I welcome any and all opposition, from Mark Kirk to anyone else.
“Now I know why the ‘smoke-filled room nine’ met in secret in Bloomington in August to ‘interview’ Hughes after Caprio took $10,000 from his creepy candidate. These men met in secret to duplicate the ‘Klavern’ tactics of the Klan. Did they burn a cross before they ‘endorsed’ Hughes?
“Hughes’ major problem is that he only ‘discovered’ the Republican Party last year, voting Republican for the first time in his life in 2008. A few months later he ‘discovered’ he was qualified to be a candidate for national office. Wow. Maybe he should go back to square one and ‘discover’ our party was founded by Abraham Lincoln. Illinois blood was shed to save the union from slavery and secession.
“Sadly, Illinois voters, and especially Republican voters, are ‘discovering’ Pat Hughes is nothing more than a campaign dummy for puppeteer D. Paul Caprio. The attack on African-American candidates is only the latest example of unfitness on the part of Caprio/Hughes. Supposedly Caprio was removed from the Hughes campaign. Obviously, that claim was false.
“As for the so-called ‘Christian’ groups that support Caprio/Hughes, I can only say ‘Jesus wept’ when he realized these craven men were attacking African-American candidates.
“I spoke with businessman Jack Roeser last week. I respect many of his views. I do not think Roeser is a racist. But if Roeser allows his ‘Champion News’ to continue to ‘champion’ Hughes & Co., Roeser will be tainted by association with the Ku Klux Klan candidate for U. S. Senator, Patrick Hughes.
“Jack, say it isn’t so.” Martin will state.
“Either Republican leaders such as Pat Brady repudiate Hughes’ racism, or Illinoisans of every persuasion will repudiate our Party.”

(CHICAGO)(October 1, 2009) Republican U. S. Senate candidate and insurgent “Internet Powerhouse” Andy Martin launches a major new high-speed rail proposal with a series of town meetings in Mattoon, Carbondale, Effingham and Fairfield. Martin’s schedule follows below.
Martin will also be speaking at Republican Party events and meeting with Republican leaders as he seeks to “blow out” Mark Kirk’s liberal campaign and discredit Kirk’s “anti-family” agenda.
“Years ago the Chicago Tribune called me an ‘absolutely brilliant campaigner,’” Martin says. “Well Southern Illinois is about to receive a blockbuster series of events that puts downstate interests front and center in the U. S. Senate race.
“I want to tie this state together, so that every region is connected to the world economy with a network of high-speed trains. A high-speed rail network will create quality infrastructure, quality jobs and add significant long-term value to the regional economy.
“In the next few days we plan to have a special web site devoted to Southern Illinois needs and concerns. Martin charges that Mark Kirk’s tainted “Beltway Dollars” from Washington lobbyists are corrupting the 2010 primary. “Why are Republican leaders disenfranchising an entire group of Senate candidates to favor Mark Kirk?” Martin will ask. “Because Kirk paid Republicans $50,000 in ‘corrupt cash.’ Kirk is the new George Ryan.”
Martin will be in Lake Forest soliciting signatures for his campaign and attacking Kirk for engaging in “pay to play” with the corrupt leadership of the Illinois Republican Party.
“I have some questions for Markie Kirk,” Martin says. “I am delighted we have both been invited to the Women’s Republican Club function, so I can confront the Markster with his bribery of Illinois Republican leaders. Previous episodes of pay-to-play destroyed the Republican Party. Some so-called ‘leaders’ have not learned their lesson. They are back grabbing Kirk’s ‘dirty dollars.’
“People say Kirk ‘raises a lot of campaign cash.’ Of course he does. He sells his vote to Exelon and other special interests. It’s easy to raise money if you’re a thief. You steal from working people and sell their vote to the highest hedge fund bidder.
“Republican Party leaders are rigging campaign events, harassing opposing U. S. Senate candidates and in general acting more in conformity with Iranian ayatollahs than traditional level-playing-field Republicans. They are having a ‘Convention’ Saturday in which only Kirk is allowed to speak, and in which the other Senate candidates opposing him are being silenced.
“Americans are dying in Afghanistan to protect this kind of sleazy politics here at home? I don’t think so. This would not be happening if John McCain was still alive.
“The Illinois Republican Party has been corrupted by Kirk’s Kash. For shame.

I understand that the Crook County Republicans are holding a “convention” this weekend. Sadly you are lending your good name to this fraudulent enterprise.
I call on you to call for an end to rigged speaking arrangements and to stop your munchkins, beginning with sleazy Eloise Gerson on down to Lee Roupas, Jon Blessing and the rest, to refrain from making a joke of the Republican Party.

Gerson and Roupas learned these dirty tricks at the feet of Andy McKenna. If you participate in their scummy shenanigans you are just as guilty as they are of gutter politics. You are compromising your role as a new party leader.
Every candidate for the U. S. Senate should be treated equally. There is a campaign on. There are a number of people campaigning actively. Favoring one candidate, who gave you $50,000, reeks of pay-to-play.
Pay-to-play, and the arrogance that accompanied that practice in the Republican Party, destroyed Republicans in Illinois. Remember George Ryan? But here you are back participating in the same kind of rigged events. Why?
Why are you insulting all of the other senate candidates? This latest maneuver is a replay of the same slimy tactics that Roupas and Gerson used at a “Young Republicans” meeting last month. (A lawsuit will eventually come out of both events; pay-to-play is illegal.)
An awful lot of people gave you a chance at a “fresh start” for the Republican Party when you took over in August. But all we see is the same old faces and the same old dirty tactics. Moreover, as a lawyer, you should know that dirty tricks eventually backfire and boomerang on the perpetrator, as indeed they eventually will on you, the party and Kirk.
Just remember, if you run a dirty campaign for your candidate, you can’t complain when the dirt comes flying back at you. It will.
Why jeopardize yourself and your good name for anyone? I can’t understand why someone as intelligent as you are would stoop to participate in Gerson’s, Roupas’ and Blessing’s dirt.
Because you have personally endorsed Kirk, there is also an actual, not potential, conflict of interest in the actions taking place under your supervision. Instead of seeking to appear fair and impartial, it seems to me you are jumping right into the muck. Can you explain to me why that is?
You should just tell these thugs (Gerson, Roupas, Blessing, etc.) that you will refuse to participate in any event that does not treat all Senate candidates fairly or that is blatantly rigged in Kirk’s favor.

I understand that the Crook County Republicans are holding a “convention” this weekend. Sadly you are lending your good name to this fraudulent enterprise.
I call on you to call for an end to rigged speaking arrangements and to stop your munchkins, beginning with sleazy Eloise Gerson on down to Lee Roupas, Jon Blessing and the rest, to refrain from making a joke of the Republican Party.
I have lost count of how many Republicans are running for the U. S. Senate. There was a bunch of them in Springfield last month. I’m the only one Kirk & Co. are afraid of.
But at the so-called “Cook County Convention” this weekend only Mark Kirk is apparently being allowed to speak:

Illinois Republicans asked to return “crooked cash” from Mark Kirk.
[Andy Martin tells a Chicago news conference that Mark Kirk is engaging in corrupt “pay to play” politics, of the type currently being prosecuted in federal court. This year I celebrate forty years since my graduation from law school. But even before I graduated, I was a corruption-fighter, tackling Daley Machine crooks in Springfield and helping out with the investigation that led to the resignation of two Illinois Supreme Court justices for taking bribes while serving on the court.
You served honorably with the Department of Justice, also in a corruption fighting capacity.
Therefore, we start with a common reservoir of experience in analyzing the Illinois Republican Party’s (“IRP’s”) current dilemma.
I am writing to address two (2) issues involving an appearance of impropriety and to invite your efforts to elevate the ethics of the IRP. First, I am writing to suggest the serious appearance of impropriety in the IRP’s acceptance of $50,000 from Mark Kirk, a candidate some members of the leadership are supporting. Second, I write to address your own prior “endorsement” of Kirk in the 2010 primary.
Many Illinoisans believe that the IRP is part of a “Combine” of corruption in state and national politics. I believe that is the case. The past and present “Combine” prosecutions in federal court clearly document bipartisan corruption.
One of the evils of Illinois politics that is currently the subject of criminal prosecution in federal court is our state’s history of “pay to play.”
Earlier this year, Mark Kirk gave $50,000 to the IRP. In return, he has received the active support of IRP members and staffers in his senate campaign. It is difficult to conceive of a more graphic example of “pay to play.” Parties are supposed to be open, and primaries are supposed to be conducted on a level playing field. But when state party leaders lock me out of the “Voter Vault,” and censor my speaking at party meetings in Springfield or the State Fair, it is clear that “pay to play” is working and having a pernicious influence in the IRP.
Just last year I carried or nearly carried forty (40) counties in the U. S. Senate primary, and received a quarter of a million votes. Attacking me is attacking the Republicans who have supported me. I can see why Kirk would want to undermine my candidacy, but why would the IRP want to help him? Pay to play.
Mark Kirk has used the party apparatus to try to eliminate his most serious primary opponent, me, simply by bribing party leaders to support his candidacy.
The IRP should not be for sale to the highest bidder. When a primary candidate gives an extremely large sum to the IRP (we would not be having this discussion if Kirk had donated $1,000), and the party thereafter supports his candidacy and seeks to undermine and denigrate his principal opponent, then the appearance of impropriety is overwhelming and must be eliminated.
Kirk’s corrupt $50,000 in cash, moreover, came from out of state donors, primarily lobbyists and special interests who had an interest in influencing Kirk’s vote in Congress. I don’t yet know if Kirk has committed crimes, but I do know that he comes cloaked with the appearance and aroma of impropriety in the extreme. Kirk’s career represents everything that is evil and corrupt in Washington.
I therefore respectfully request that the IRP return Mr. Kirk’s $50,000. That sum is so large and its role in the IRP’s subsequent support of Kirk’s candidacy is so extreme, that the appearance of impropriety cannot be allowed to stand.
In 2006 the IRP conducted a relatively honest primary, and the result was that after the primary all of the candidates on the ballot supported the winner. If you allow Kirk’s corrupt cash contribution to stand, then no one will support Kirk after the primary, and you will lead a divided party into the general election. Is that worth $50,000? You will be jeopardizing the entire ticket solely to accommodate Mr. Kirk.
Secondly, prior to your becoming party chairman you personally endorsed Mr. Kirk. Private citizens, of course, are free to endorse whom they wish. But you are no longer a private citizen. You lead a state party with many candidates and many conflicting campaigns. Indeed, the IRP has asserted a fiduciary claim to the use of the very term “Republican.”
When Mr. Kirk announced, the names of some “supporters” were fraudulently added to his list of endorsers. You cannot, consistently with your fiduciary duty to the entire party as party chairman, remain an open supporter of Mark Kirk. Once again, the appearance of impropriety would be overwhelming. The “chairman” of an organization is usually someone who is required to be neutral.
When you leave the chairmanship of the IRP some day, all you will take with you is your good name. Sadly, Andy McKenna played dirty politics with Republicans, and when he departed no one really minded and McKenna’s “good name” was a thing of history. Even the Combine was forced to dump him after a Sangamon County judge effectively ruled he had violated my civil rights.
The temptation to act for short run gain may be seductive; but that temptation can have lethal long-term consequences, as we have seen with the decline of the IRP and McKenna’s demise.
I am occasionally criticized for exposing and prosecuting Republican corruption. Some people say “don't speak ill of another Republican.” But when I see a crook, I see a crook, I do not see a Democrat or Republican. Corruption in this state is bipartisan. It is largely due to the failure of the Republican Party to vigorously oppose corruption, and to participate in profiting from the affairs of the Combine, that our party has gone into decline and public ridicule. We cannot condemn Democratic Party’s “pay to play” when we are doing the same thing ourselves with Mark Kirk’s $50,000 bribe to party leaders.
I urge you to do the right thing, and to return Kirk’s money. I also urge you to openly and visibly withdraw your endorsement of Kirk and adhere to the view that as IRP Chairman you should be neutral and not take sides in party primaries.
An open and honest primary will pay big dividends. A crooked and rigged primary will leave serious liabilities. The choice is yours.
